I, JA YCE HOWELL, being first duly sworn upon his oath, deposes and says:
1. I am the Manager and authorized officer of Geneva Land and Cattle, LLC, an
Idaho Limited Liability Company, hereinafter referred to as the "Company".
2. The Company purchased and is the present owner of the property described
in the Warranty Deed recorded in Book 622 at Page 184 (Receiving #919015 on
6/2/2006), of the Lincoln County Clerk's Office records, State of Wyoming. Said
conveyance referred to the property (hereinafter referred to as the "Property") as:
Lot 1 and Lot 2 of Block 4 of the Bedford Townsite, Lincoln County,
Wyoming, as described on the official plat thereof (Excepting therefrom
the property conveyed by Warranty Deed recorded in Book 162 PR on
page 685),
Lots 1 and 2 of Block 5 of the Bedford Townsite, Lincoln County,
Wyoming, as described on the official plat thereof, and
Lot 5 of Block 5 of the Bedford Townsite, Second Filing, Lincoln
County, Wyoming, as described on the official plat thereof.
3. Subsequent to the conveyance ofthe Property to the Company, new plats were
recorded to subdivide the Lots therein, to wit:
Townsite of Bedford, Block 5, Third Filing, Receiving #919297 on
6/14/2006, Lincoln County Clerk's Office, and
Townsite of Bedford, Block 5, Fourth Filing, Receiving #919298 on
6/14/2006, Lincoln County Clerk's Office.
4. The Company was omitted from being shown as the Owner of the Property on
the said new Plats.
5. The Company hereby consents to and ratifies the above Plats being recorded
and the respective Property(ies) being subdivided in accordance with and pursuant
thereto.
6. The Plat recorded as Receiving #923071 on 10/4/2006 (known as the
Townsite of Bedford Block 5 Fifth Filing) contains the following language in the
"Certificate of Owners":
"That the Utilities Right-of-Way Easements, as shown hereon, are and
shall be granted to the owners, successors, and assigns of each lot as
affected. "
when in fact, there are no Utilities Right-of-Way Easements shown on the said Plat, nor
intended.
