DISTRIBUTION EASEMENT

That the Wldcrsigncd, Eagell' D. Rob"Q aod Gale Lynn Roberti, Husband and W~e, ("Grantor") for i
¡cod and valuable consideration, the receipt ofwmch is hereby aclmowledged, do hereby grant, convey and
warrant unto Lower Valley Energy, a Cooperative Corporation, of Afton and Jackson, Wyoming and to ils
successors and assigns, ("Grantees"), Ii perpetual easement and right of way for ~ construction an·j
continued maintenance, repair, alteration and replacement of the electric distribution circuits, lines an i
equipment oftbe Grantee to be constructed and maintained under, upon and across the premises of Granter
in Lincoln COUDty, State of Wyoming, along a line descn'bed as follows, to wit:
BEING a part of The Aspens at Clark Lane Subdivision, Phase 2 Second Filing, Lot 15, Section 24, T35N,
Rl19W, in Lincoln County, Wyoming more accurately described as follows,
BEGINNING 10 feet South, 30 feet East from the Northwest comer of said Lot 15. The N 83°E, 150 feet to
a transformer location.
E~MENT to include 10 feet on each side of described line, together with all necessary and reasonable
rights of ingress and egress and to excavate and refill ditches and trenches for the location and repair of said
facilities and to cut, trim, spray herbicides, or remove trees, sluubbery, undergrowth or other obstructiou
interfering with the repair and maintenance of the facilities.
The Grsntor aclmowledges that Electric and Magnetic Fields (EMF) arc naturally occurring in tl e
transmission Of distribution of electricity, and that the Grantee has here notified Grantor that EMF testir.g
and infonnation is available upon request from !be Grantee, This Easement by Grantor is intended 10
include so much space as is necessary or appropriate to the presence of EMF and reasonable operation IIf
the Grantee's distribution lines.
Grantor agrees that all poles, wires and other facilities, installed on or under the described lands shall
remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expens:.
The rights, conditions and provisions of this easement shall inure to the benefit of and be binding upon the
parties, their heirs, executors, administrators, successors and assigns. Grantor shall compensate Grantee tì)f
any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees if
action is undertaken by Grantee to enforce the connnitments described in this easement. Grantor reserv.:s
the right to improve, occupy and use this easement for all purposes not inconsistent with the easement graIlt.
Each party shall have the remedy of specific performance regarding this easement. The rights alld
obligations described in this easement shall run with the land. This easement is not exclusive, and Grant,}t'
retains aU rights not specifically granted by this easement. llis is the entire agreement of the parti =s
regardi~ this easement, except as may be set forth in writing after the date oftms easement and signed hy
