I am a resident of Salt Lake City, Utah, and am over the age of twenty-one years. 2. I am a paralegal, employed by Lear & Lear L.L.P., experienced in dealing with county records and the records of the Bureau of Land Management. 3. A search performed in the records of the Recorder's Office in Lincoln County, Wyoming, disclosed that the following placer mining claims have been indexed against certain federally owned lands in Section 12 of Township 23 North, Range 118 West, 6th P.M.("Section 12 Lands"): a. Placer Mining Claim for Petroleum dated February 14, 1902" located by P.D. Stinson, et al. on the N~N~ of the Section 12 Lands. The claim was recorded March 3, 1902, in Book K of the Mixed Record, at Page 119. b. Placer Mining Claim for Petroleum dated February 14, 1902, located by P.D. Stinson, et al. on the SY2N~ of the Section 12 Lands. The claim was recorded March 3, 1902, in Book K of the Mixed Record, at Page 120. c. Placer Mining Claim for Petroleum located dated February 14, 1902, by P.D. Stinson, et al. on the N~S~ of the Section 12 Lands. The claim was recorded March 3, 1902, in Book K of the Mixed Record, at Page 120. d. Placer Mining Claim for Petroleum dated February 14, 1902, located by P.D. Stinson, et al. on the S~S~ of the Section 12 Lands. The claim was recorded March 3, 1902, in Book K ofthe Mixed Record, at Page 121. {00018429.1} 00021.5 4. My review of the on-line electronic records of the Bureau of Land Management, covering lands in Lincoln County, Wyoming, discloses that there are no current mining claims extant on the Section 12 Lands. 5. Information received from the Bureau of Land Management, including the attached letter from Pamela 1. Stiles, Land Law Examiner, Branch of Solid Minerals, Wyoming State office of the Bureau of Land Management, confirms that the placer mining claims, identified in Paragraph 3a through 3d herein, which were located by P. D. Stinson are no longer valid. 6. The matters stated herein are true and correct to the best of my knowledge, information and belief. You questioned the validity of the mining claims located by P.D. Stinson on February 12, 1902. Your concern was that the claims do not appear in the BLM records, but do appear in the County records. Mining claims were not required to be recorded with BLM until the passage of the Federal Land Policy and Management Act of 1976 (FLPMA). All mining'claims on federal land must have been recorded with BLM no later than October of 1979 to remain on public land. Any claims not recorded by that time were no longer considered valid claims and not recognized by BLM. Petroleum was a locatable mineral prior to 1920. With the passage of the Mineral Leasing Act of 1920 all petroleum, gas and oil shale became leasable minerals. However, any mining claims located for those minerals prior to 1920 could remain valid if the claims were properly maintained yearly. As we discussed, if the claims were never recorded with BLM they ceased to be valid claims in 1979 and were never recognized by BLM. Our records indicate that the claims you question were never recorded with us, and therefore do not exist as a cloud on the title to the land in question. The information concerning the claims in the county is the only information available on these claims, as that was the venue for filing the claims prior to 1976. Just because there is information concerning the claims in the county does not mean that they are still valid claims to date. Again unless they were recorded with BLM and maintained yearly (which these claims were not) they are not recognized as mining claims.
