OLSEN, III, a married man dealing with his sole and separate property as to income, principal and appreciation, and REBECA V. OLSEN, his wife, as to any homestead right, of Cache County, State of Utah, the "Grantors," and EDWIN C. OLSEN, III, and REBECA V. OLSEN, not individually, but as trustees of THE EDWIN C. OLSEN, Ill, and REBECA V. OLSEN FAMILY TRUST, whose mailing address is 1073 Fox Farm Road, Logan, UT 84321, the "Grantee." WITNESSETH, that the Grantors, for and in consideration of the sum of Ten Dollars ($10.00) lawful money of the United States of America, and other good and valuable consideration, to the Grantors in hand paid by the Grantee, the receipt whereof is hereby acknowledged, have granted, and by these presents do grant and confIrm unto the Grantee, and to Grantee's heirs and assigns forever, all of the following described property in the County of Lincoln, State of Wyoming, to-wit: Lots 1 and 2, Livingston Subdivision, according to the official plat thereof on fIle and of record in the offIce of said County Recorder. TOGETHER with all improvements, water, water rights and appurtenances thereunto belonging or otherwise appertaining, including Bertagnole Well No. 1 (P. No. U. W. 6564) 55 g.p.m., as shown on the State of Wyoming CertifIcate of Appropriation of Ground Water, which Certificate was recorded May 24, 1974 at 1 :00 p.m. in Book 112PR, Page 204, Kemmerer, Wyoming, as Entry No. 456967. (Said CertifIcate is in the name of F. J. and Hazel G. Bertagnole, and said F. J. Bertagnole and Frank J. Bertagnole are one and the same person). TOGETHER with all and singular the tenements, hereditaments and appurtenances thereunder belonging or in anywise appertaining, and the reversions, remainder and remainders, and rents, issues and profIts thereof; and all estate, right, title and interest in and to said property, as well in law as in equity, of said property. 000826 SUBJECT to all existing easements or claims of easements, patent reservations, rights of way, protective covenants, zoning ordinances, and applicable building codes, laws and regulations, encroachments, overlaps, boundary line disputes and other matters which would be disclosed by an accurate surveyor inspection of the premises. TOGETHER with the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, and any reversions, any remainders, and rents, issues and profits therefrom; and all estate, right, title and interest in and to said property, as well in law as in equity, of the Grantors. TO HAVE AND TO HOLD, the premises and the appurtenances unto the Grantee, and to Grantee's heirs and assigns forever. In construing this deed and where the context so requires, the singular includes the plural.
