4. That he is the son of Serell G. Hurd and a beneficiary of the trust referred to, that
Serell G. Hurd became deceased on April 10, 2007, that upon the death of Serell G. Hurd, Dale H.
Hurd and he became the trustees of the Serell G. Hurd Decedent's Trust dated June 16, 1999.
5. That as of April 10, 2007, the date of death of Serell G. Hurd, Kenneth H. Hurd and
Dale H. Hurd became the trustees of the Serell G. Hurd Decedent's Trust dated June 16, 1999,
including its ownership of the real property described above, .and that they are currently lawfully
serving in that capacity.
