HomeMy WebLinkAbout934637 WORK ORDER # 64395 ·SEC. 29, T37N, Rl18W DISTRIBUTION EASEMENT KNOW ALL MEN BY THESE PRESENT: 000836 TIlat the undersigncd, IRISH PROPERTIES, LLC, a Wyoming limited liability company, ("Grantor'') tor a good and valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, convey and WéUTant untu Lowt:r VaHey Energy, a Cooperative Corporation, of Anon and Jacksoll, Wyoming and to its successors and assigns, ("Grantees"), a perpetual easement and right of way for tr.e construction and continued maintenance, repair, alteration and replacement of the electric distribution circuits, lines and cqllipm~\Jt of the Grantee to be constmcted and maintained under, upon and across tre premises of GTantor in Ullcoln County, State of Wyoming, along a line described as follows, to wit: BEING a pOl1ion of Tract 3A of Palis Park Subdivision within the NWl/4SEl/4 of Section 29, T37N, R 118W, witlùn the Town of Alpine, Lincoln County, Wyoming more accurately descJ;bed as follows: BEGINNING at u point being the NE comer of said Tract 3A. Thence S 20035'OO''W, 105 feet to a point. Easement to include a strip of land 20 feet in width running parallel with East line of said Tract 3A. EASElVIENT to include 1 () feet on each side of described line, together with all necessary and reasonabi e rights of ingress and egress and to excavate and refil1 ditches and trenches for thc location and rcpair of said facilities and to cut, trim, spray herbicides, or remove trees, shrubbery, undergrowth or other obstructior.s interfering with the repair and maintenance of the facilities. The Grantor acknowledges that Electric and Mab'11t::lic Fielùs (EMF) are naturally OCCUlTIng in Ltc transmission or distribution of clcctTicity, and that the Grantee has here notified Grantor that EMF testirg ami information is av..Übble upon request ÜOI11 the Grantee. This Easement by Grantor is intended 10 include so much space as is necessalY or appropriate to the presence of EMF and reasonable operation of the Grantee's disl1ihution lines. '1 Grantor agrees that all poles, wires and othl;;r facilities, installed on or under the described lands shall remain the property ofthc Grantee removable in the sole discretion of the Grantee at the Grantee's expens~. The rights, conditions and provisions of this casement shall inure to the benefit of and be binding upon tbe parties, their heirs, executors, administrators, succe8sors and assign8. Grantor shall compensate Grantee {ì)f any damages to Grantee's ÜlcilitieR cauRed by Grantor, including payment of Grantee's attorney fees if action is undertaken by Grantee to enforce the commitments described in this casement. Grantor reserv(:s the right to improve, occupy and use this easement for aU purposes not inconsistent with the easement grart. Each party shall have the rcmcdy of specific perfonnance regarding this easement. The rights ard obligations d~sclibed in this easement sha11 run with the land. This easement is not exclusive, and Grantor retail1~, all rights not specifically granted by this easement.
