HomeMy WebLinkAbout934970 Exhibit "D" UNDERGROUND UTILITY EASEMENT 0001.03 Whipple Development Corporation, a South Carolina Corporation, GRANTOR, for and in consideration of TEN DOLLARS ($10.00) and other good and valuable consideration, in hand paid, receipt and sufficiency of which is hereby acknowledged, CONVEYS AND WARRANTS to Michael Kibbie, Hi-Line Equipment Company, a Utah Partnership, Robert R. Meikle, Byron Barkley, Steve Chichinsl1y and Carol ChichinsKy, husband and wife, their respective heirs, successors, and assigns, GRANTEES, whose address is c/o Vehar Law Offices, P.C., 912 Main Street, Evanston, Wyoming 82930, a non-exclusive underground utility easement ten feet (10') in width, to be used to utility purposes, under, across and within that portion of Judicial Easement dated August 21, 1996 which traverses Grantor's lands, as is more particularly described at Exhibit 'A' attached hereto and incorporated by this reference. The Judicial Easement was filed for record with the Lincoln County Clerk on August 26, 1996 in Book 387 PR "/ fø at page 412, and is incorporated herein by this reference. The within grant is intended to be an easement running with lands of Grantees which it serves and shall be perpetual so long as it is used for utility purposes.
