~~~~t, 1986, by and between PUTNAM RANCH and PUTNAM REAL ESTATE
LTD., Utah partnerships, hereinafter referred to as Grantors,
1<. LAVAR and ELVA H. PUTNAM, hereinafter referred to·as Grantees.
Grantors and Grantees hereby agree that it is. their intent
to create a covenant or condition with·th~ land relative to .the
. gravel for the benefit of all parties.· The Grantees and··Gr~n~ors
agree that the Grantors shall have the ability to use withou~ any
aocountability the gravel on any and all lands for·the personal
use of the Grantors and their heirs and assigns.
So as to protect the surface rights of Grantors, the parties
hereby agree that any and all gravel (excavation) rights are .
limited to reasonable methods to protect the rights of the. Grantors·
from. damage to surface. Grantors shall be compensated for::. any· and
all damage to surface and particularly damage to orops. . .
The parties hereby agree that they shall oooperate with one
another to enable the Grantors or their assigns to protect, the
surfaoe use and that neither party will ~onsent t~ the sale·of
gravel without the oonsent of all parties, includirigthe surface
owners (subject to the consent of the Grantors not being unreaso-
nably withheld) and further subjeot to the condition that so long
as the purchaser of the gravel shall extract such in a commer~·
clal1y reasonable manner without damage to the surface and will
cooperate in the reclamation of the ground. So long as the .
Grantors or their assigns are compensated for surface damage,
they shall not unreasonably withhold. .
Any funds which are due upon sale of the gravel shall be paid
to'the Grantors or its assign and shall be ,disbursed as moniés Bre
actually received in accordance with the interest of the various
gravel owners. '
