Linda Brown Family Trust, dated 11 December 2001, Jay Fredrick Brown and
Linda K. Brown, Trustees, and Vance S. Welch and Amanda Ellen Welch, husband
and wife, of Afton, Lincoln County, Wyoming and Doug Hillyard and Loni Hillyard,
husband and wife, of Afton, Lincoln County, Wyoming, Grantors, for and in
consideration often dollars ($10.00) and other valuable consideration, in hand paid,
receipt of which is ac1mowledged, grant and convey to The Town of Afton, a Wyoming
municipal corporation, Grantee, the following described perpetual right-of-way and
utilities easement for the following purposes:
1. Purpose of Easement. This easement is for the purpose of providing a perpetual
non-exclusive 80-foot wide right-of-way and utilities easement for ingress and egress and
all underground utilities to the property described in paragraph 3 including the right to
construct, install, and maintain a roadway and all underground utilities, and including the
right to inspect the easement. In addition, Grantors hereby agree to cooperate in the
dedication of said right-of-way, for use by the public, to the Town of Afton, Wyoming,
by executing such documents as may be deemed necessary to accomplish such
dedication.

Conditions of this Easement. The conditions of this easement are:

a. By accepting, constructing or installing a roadway or underground utilities
in, using, or providing for or allowing any third parties to use the herein described
easement, Grantee assumes the risk of any and all damage including property or personal
damage and agrees to indenmify and hold Grantors harmless from any damage, whether
property or personal arising f01111 any such activities conducted by Grantee on or in the
easement. If any third party is injured or damaged in any way related to the use or
maintenance of the herein described easement, Grantee agrees to indemnify and hold
Grantors harmless therefrom.
3. Property Benefited by Easement. This easement is for the benefit of the public
for the following described real property located in Afton, Lincoln County, Wyoming:

5. Binding Effect. The tenns and conditions ofthis easement shall be binding upon
and inure to the benefit of the heirs, successors in interest and assigns of the parties
named in this instrument and to the public as a public right-of-way.

6. Waiver of. Homestead Rights. The Grantors hereby waive and release all rights
