By this instrument, the holder: Kerr-McGee Oil & Gas Onshore, LP 1999 Broadway, Suite 3700 Denver, CO 80202 receives a right to construct, operate, maintain, and terminate an access road to the Ballerina 10-15 and Ballerina 20-15 wells, on public lands in Lincoln County, Wyoming described as follows: 6th PM. T. 21 N., R. 113 W., sec. 22, NENENW c. The permit area granted herein is 30 feet wide, 175 feet long and contains 0.120 acres, more or less. ~~\p ~l? \.9 . ~ö This instrument shall terminate on December 31, 2037, unless, prior thereto, it is relinquished, abandoned, terminated, or modified pursuant to the terms and conditions of this instrument or of any applicable Federal law or regulation. b. d. Notwithstanding the expiration of this instrument or any renewal thereof, early relinquishment, abandonment, or termination, the provisions of this instrument, to the extent applicable, shall continue in effect and shall be binding on the holder, its successors, or assigns, until they have fully satisfied the obligations and/or liabilities accruing herein before or on account of the expiration, or prior termination, of the permit. 3. Provided, however, that the rental may be adjusted by the authorized officer, whenever necessary, to reflect changes in the fair market rental value as detennined by the application of sound business management principles, and so far as practicable and feasible, in accordance with comparable commercial practices. Tenns and Conditions: a. This pennit is issued subject to the holder's compliance with all applicable regulations contained in Title 43 Code of Federal Regulations part 2800. b. Upon pennit tennination by the authorized officer, all improvements shall be removed trom the public lands within 90 days, or otherwise disposed of as provided in paragraph X (4)(d) or as directed by the authorized officer. c. Each pennit issued for a tenn of 20 years or more shall, at a minimum, be reviewed by the authorized officer at the end of the 20th year and at regular intervals thereafter not to exceed 10 years. Provided, however, that a pennit granted herein may be reviewed at any . time deemed necessary by the authorized officer. d. The stipulations, plans, maps, or designs set forth in Exhibits A and B, dated August 28, 2007, attached hereto, are incorporated into and made a part of this pennit instrument as fully and effectively as if they were set forth herein in their entirety. e. Failure of the holder to comply with applicable law or any provision of this pennit shall constitute grounds for suspension or tennination thereof. f. The holder shall perfonn all operations in a good and workmanlike manner so as to ensure protection of the envirollinent and the health and safety of the public. g. The holder shall construct, operate, and maintain the facilities, improvements, and structures within this right-of-way in strict confonnity with the plan of development which was approved and made part of the pennit on August 28, 2007. Any relocation, additional construction, or use that is not in accord with the approved plan of development, shall not be initiated without the prior written approval of the authorized officer. A copy of the complete pennit, including all stipulations and approved plan of development, shall be made available on the right-of-way area during construction, operation, and tennination to the authorized officer. Noncompliance with the above will be grounds for immediate temporary suspension of activities if it constitutes a threat to public health and safety or the environment. 000533 3 h. The authorized officer may require that all parties (including the holder), receiving or holding a right-of-way which is subject to this or a similar stipulation and which overlaps on the ground with the subject right-of-way, must enter into a road maintenance agreement acceptable to the authorized officer. The requirement will be based upon a detennination by the authorized officer that road maintenance is inadequate or that any party is not contributing to a share of the maintenance proportionate to road use. All parties to the agreement will be jointly and individually responsible for maintenance adequate to offset road use and damage by any party to the agreement. Those receiving future right-of-way grants or other written authorizations from the Federal government to use any part of this right-of-way will be allowed to enter into said agreement. 1. Any cultural and/or paleontological resource (historic or prehistoric site or object) discovered by the holder, or any person working on his behalf, on public or Federal land shall be immediately reported to the authorized officer. Holder shall suspend all operations in the immediate area of such discovery until written authorization to proceed is issued by the authorized officer. An evaluation of the discovery will be made by the authorized officer to detennine appropriate actions to prevent the loss of significant cultural or scientific values. The holder will be responsible for the cost of evaluation and any decision as to proper mitigation measures will be made by the authorized officer after consulting with the holder. J. The holder shall conduct all activities associated with the construction, operation, and tennination of the right-of-way within the authorized limits of the right-of-way. k. The holder shall seed all disturbed areas with the seed mixture listed below. The seed mixture shall be planted in the amounts specified in pounds of pure live seed (PLS)/acre. There shall be no primary or secondary noxious weed seed in the seed mixture. Seed shall be tested and the viability testing of seed shall be done in accordance with State law(s) and within nine months prior to purchase. Commercial seed shall be either certified or registered seed. The seed mixture container shall be tagged in accordance with State law(s) and available for inspection by the authorized officer. Seed shall be planted using a drill equipped with a depth regulator to ensure proper depth of planting where drilling is possible. The seed mixture shall be evenly and unifonnly planted over the disturbed area. (Smallerlheavier seeds have a tendency to drop to the bottom of the drill and are planted first. The holder shall take appropriate measures to ensure this does not occur.) Where drilling is not possible, seed shall be broadcast and the area shall be raked or chained to cover the seed. When broadcasting the seed, the pounds per acre noted below are to be doubled. The seeding will be repeated until a satisfactory stand is established as detennined by the authorized officer. Evaluation of growth will not be made before completion of the second growing .season after seeding. The authorized officer is to be notified a minimum of ten days prior to seeding of the project. The Holder shall be responsible for total control of all invasive/noxious weed species on any and all disturbed sites, including areas outside the development where weeds have established due to project installation and development. If at all possible all vehicles and equipment used for project construction and developments should be power or high pressure washed prior to entering the project area. Guidelines in Partners Against Weeds, An Action Plan for the Bureau of Land Management needs to be followed as outlined in Appendix 4 as a prototype for weed prevention measures on public lands. The Holder is responsible for consultation with the Authorized Officer and/or local authorities for acceptable weed control methods, and shall comply with the following: Use of pesticides shall comply with all applicable Federal and State laws. Pesticides shall be used only in accordance with their registered uses within limitations imposed by the Secretary of the Interior. Prior to the use of the pesticides, the Holder shall obtain from the Authorized Officer, written approval of a Pesticide Use Proposal Plan showing the type and quantity of material to be used, pest(s) to be controlled, method of application, locations of storage and disposal of containers, and any other information deemed necessary by the Authorized Officer. Applicator(s) of chemicals used must have completed the pesticide certification training and have a current up to date Certified Pesticide Applicator's License. Pesticide Application Records for the areas and acres treated must be submitted to the BLM Kemmerer Field Office each year. This includes the following: Brand or Product name EP A registration number Total amount applied (use rate #A.I./acre) Date of application Location of application Size of area treated Method of treatment (air/ground) Name of applicator Certification number Amount of surf act ants or dyes used in spraying operation The record information must be recorded no later than 14 days following the pesticide application and must be maintained for ten years. 000535 5 m. If snow removal from the road is undertaken, equipment used for snow removal operations shall be equipped with shoes to keep the blade 2 inches off the road surface. Holder shall take special precautions where the surface of the ground is uneven and at drainage crossings to ensure that equipment blades do not destroy vegetation. n. Holder shall maintain the right-of-way in a safe, usable condition, as directed by the authorized officer. (A regular maintenance program shall include, but is not limited to, blading, ditching, culvert installation, and surfacing). o. The holder of Right-of- W ay No. WYW - 171127 agrees to indemnify the United States against any liability arising from the release of any hazardous substance or hazardous waste (as these terms are defined in the Comprehensive Environmental Response, Compensation and Liability Act of 1980,42 V.S.C. 9601, et seq. Or the Resource Conservation and Recovery Act of 1976,42 U.S.C. 6901 et seq.) On the right-of-way (unless the release or threatened release is wholly unrelated to the right-of-way holder's activity on the right-of-way). This agreement applies without regard to whether a release is caused by the holder, its agent, or unrelated third parties. p. Ninety days prior to termination of the right-of-way, the holder shall contact the authorized officer to arrange a joint inspection of the right-of-way. This inspection will be held to agree to an acceptable termination (and rehabilitation) plan. This plan shall include, but is not limited to, removal of facilities, drainage structures, or surface material, recontouring, topsoiling, or seeding. The authorized officer must approve the plan in writing prior to the holder's commencement of any termination activities. The undersigned agrees to the terms and conditions of this permit. The proposed route will provide access to the proposed oil and gas drilIsites on fee Iands for the Ballerina 10-15 and the Ballerina 20-15 in Lot 1 (NW/4 NW/4) and NW/4 NE/4, respectively in Sec. 15 T21N R113W, to which there is no other reasonable access from the Lincoln, Sweetwater, or Uinta County roads. This subITÚttal covers a Right-of-Way (ROW) request for an existing access road situated off lease on federal lands leading to the Ballerina 10-15 and the Ballerina 20-15, consisting of ±175' (0.03 miles) in the NE/4 NW/4 of Sec. 22 T21N Rl13W to Highway 30 in Sec. 22 T21N Rl13W. The proposed location for the Ballerina 10-15 is 1,120' FNL 1,320' FWL (NW/4 NW/4) - Lot 1 of Sec. 15 T2lN Rl13W. The wellsite was surveyed and staked on October 3, 2006, by D.R. Griffm & Associates, Inc. (DRG), on behalf of Kerr-McGee on a site that was geologically and topographically acceptable. " The proposed Ioc~tion for the BáÎÍerina 20-15 is 1,120' FNL 1,520' FEL (NW/4 NE/4) of Sec. 15 T21N Rl13W. The wellsite was surveyed and staked on May 30,2007, by DRG, on behalf of Kerr-McGee on a site that was geoIogically, legally, and topographically acceptable. An Application for Permit Drill (APD) for each well location will be filed separately with the Wyoming Oil and Gas Conservation ÇdJ:nmission (WOGCC), with courtesy copies to be subITÚtted separately to the Bureau of Land Management (BLM) in Kemmerer. Total proposed access road length is ±8,022' (1.52 ITÚles) on Uinta Development Company (Uinta) surface for both Iocations, with ±5,091' (0.96 miles) leading to the Ballerina 10-15 and ±2,931' (0.56 ITÚles) dedicated to the Ballerina 20-15. The existing access road consisting of ±2oo' (0.04 miles) in Sec. 15 T21N Rl13W is also located on Uinta surface to Highway 30 in NE/4 NW/4 Sec. 22 T21N Rl13W. Surface use agreements have been executed for utilizing private roads to this location between Kerr-McGee and Uinta. B) Borrow ditches to be backsloped 3:1 or shallower. C) Maximum grades shall not exceed BLM standards. D) Six (6) 18" x 30' culverts will be installed prior to commencement of drilling operations in Sec. 15 T21N RI13W. Three (3) culverts will be constructed on the fee surface access road leading to the Ballerina 10-15 and three (3) culverts will be constructed on the fee surface access road dedicated to the Ballerina 20-15 (See Exhibit 4). Drainage to consist of borrow ditches on both sides. Culvert sizes to be a minimum of 18" diameter. The borrow ditches along the proposed access road will be re-seeded if the well is completed as a producer. The reseeding of the borrow ditches will reduce the area utilized by this location. E) Surfacing materials to consist of native material from the road crown, topsoil to be windrowed during construction and placed in the borrow ditch backslope upon road completion, backslope of borrow ditch will be re-seeded per Section 10E of this Surface Use PIan. During reclamation, backslope of borrow ditch will be re-seeded per Section lOE of this Surface Use PIan. P) No major road cuts are necessary. G) Fence cuts, gates, and cattIe guards will not be required. H) Tþere is a crossipg of an overhead powerline located in SW/4 NW/4 Sec. 15 T21N R113W, approximately 25'-30' in height on the access road leading to the BalIerina 10-15. The power company will be contacted prior to construction. No disturbance to the line is anticipated. LOCATION OF WATER SUPPLY (See Exhibit 5) A) Water will be transported by truck from the town of Granger, Wyoming under existing permits or other available commercial sources. B) Anticipated water use is as follows: Mud drilling water requirements are anticipated to be approximately· 10,814 bbIs (454,188 gallon [US, liquid] = 1.3938419 acre foot [US survey]). Road watering will be done only if dry conditions dictate, and would utilize approximately 900 bbls (37,800 gallons or 0.11 acre feet). SOURCE OF CONSTRUCTION MATERIALS A) Construction materials will consist of native materials from borrow ditches and Iocation areas. B) Surfacing materials will be obtained from available permitted sources, if needed, and consist of pit gravel. RECLAMATION A) Topsoil will be removed prior to location construction from all disturbed areas. Topsoil depth to be removed is 6" as stipulated by BLM. Backfilling, leveling and contouring are planned as soon as all pits have dried. Waste and spoils materials will be buried immediately after drilling is completed. If production is obtained, the unused area will be restored as soon as possible. The soil-banked material will be spread over the area. Revegetation will be accomplished by planting mixed grasses as per formula by BLM. Revegetation is recommended for road area as well as around drilI pad. The rehabilitation will begin after the drilling rig is removed. Removal of oil or other adverse substances will begin immediately or area will be flagged and fenced. Other cleanup will be done as needed. Planting and re-vegetation is considered best in fall, unless requested otherwise. . Flora consists of: Ballerina 10-15 - Big sagebrush, Matchbrush, PWox, Prickly péar, ShadscaIe saltbrush, Spiny hopsage, Spiny horsebrush, Bottlebrush squirreltail, Groundsel, Black sagebrush, Bluegrass, Indian ricegrass, Needle and thread, and Western Wheatgrass. Ballerina 20-15 - Big sagebrush, Matchbrush, PWox, Prickly pear, Shadscale saltbrush, Winterfat, Black sagebrush, Mustard, Wild onion, Bottlebrush squirreltail, Bluegrass, Indian ricegrass, and Western Wheatgrass. ArchaeoIogical, cuItural and historical information will not be necessary for the portion of existing road applied for. Hazardous Materials will be handled in compliance with the guidelines as set forth in the Moxa Arch Environmental Impact Statement. Kerr-McGee Oil & Gas Onshore LP maintains a file, per 29 CPR 191O.12oo(g) containing current Material Safety Data Sheets (MSDS) for all chemicals, compounds, and/or substances which are used during the course of construction, driIling, completion, and production operations for this project. Hazardous materials (substances) which may be transported across these lands may include drilling mud and cementing products which are primarily inhalation hazards, fuels (flammable and/or combustible), materials that may be necessary for well completion/stimulation activities such as flammable or combustible substances and acids/gels (corrosives). The opportunity for Superfund Amendments and Reauthorization Act (SARA) listed Extremely Hazardous Substances (EHS) at the site is generally limited to proprietary treating chemicals. All hazardous substances, EHS, and commercial preparations will be handled in an appropriate manner to minimize the potential for leaks or spills to the environment. See the attached Table 1. I) J) K) Kerr-McGee OiI & Gas Onshore LP and its contractors will comply with all applicable federal laws and regulations existing or thereafter enacted or promulgated. Kerr-McGee and its contractors will locate, handle and store hazardous subsjancesin an appropriate manner that prevents them from contaminating soil and water resources' or otherwise sensitive environments. Any release of hazardous sub,stances (Ieaks, spills, etc.) in excess of the reportable quantities established by 40 CPR, Part 117, would be reported as required by the Comprehensive Environmental Response, Compensation and Liability Act . (CERCLA) of 1980, as amended.
