COUNTY OF SAN LUIS OBISBO ) Damien Mavis, being duly sworn on his oath deposes and states as follows: 1. I am over the age of 18 and of sound mind, and the following matters are of personal knowledge to me. 2. This Affidavit is made in confonnance with Wyoming Statute § 34-11-101 and affects the following described real property located in Lincoln County, Wyoming: a. All Lots shown and described on the Snake River Junction First Filing Plat recorded under Receiving # 925355 on December 15,2006 in the Office of the Lincoln County Wyoming Clerk. b. All Lots shown and described on the Snake River Junction Second Filing Plat recorded under Receiving # 932576 on August 29, 2007 in the Office of the Lincoln County Wyoming Clerk. ' 3. I am and have been since August 22, 2003 the President of Covelop, Inc., a California corporation (hereafter "Covelop"), fonnerly called Mavis and Vernon Properties, Inc., a California corporation (hereafter "Mavis and Vernon"). 4. Brad Vernon is and has been since August 22, 2003 the Secretary of Covelop (fonnerly Mavis and Vernon). 5. Mavis and Vernon fonnally changed its name to Covelop on February 22,2006. 6. Both Brad Vernon and I have and at all times relevant to this Affidavit had corporate authority to sign documents on behalf of and binding Covelop and Mavis and Vernon. 7. Covelop (fonnerly Mavis anå Vernon) is the appointed Manager of Alpine Development Group, LLC, with full authority to bind Alpine Development Group, LLC. 8. Alpine Development Group, LLC was the owner of the lands described in the plats identified in paragraph 2 above when said subdivision plats were recorded and when the documents identified in paragraph 9 below were executed. 9. Upon review of certain recorded documents in relation to the real properties identified in paragraph 2 above, it is apparent that said documents were not properly signed by Alpine Development Group, LLC in its capacity as the owner and developer of the real properties identified in paragraph 2 above, including: í~:OO~1!.° ~ U_.'4...I a. April 13, 2007 Warranty Deed from Alpine Development Group to Monica Mason for Lot 1, Snake River Junction First Filing Subdivision, recorded under Receiving # 928793 on April 26, 2007 in the Office of the Lincoln County Wyoming Clerk. b. April 13, 2007 Warranty Deed from Alpine Development Group to Herbert T. Adams for Lot 2, Snake River Junction First Filing Subdivision, recorded under Receiving # 928795 on April 26, 2007 in the Office of the Lincoln County Wyoming Clerk. c. April 13, 2007 Warranty Deed from Alpine Development Group to Baxter G. Troutman for Lot 3, Snake River Junction First Filing Subdivision, recorded under Receiving # 928767 on April 25, 2007 in the Office of the Lincoln County Wyoming Clerk. d. June 15, 2007 Warranty Deed from Alpine Development Group to Alpine Commercial Development Inc. for Lot 4, Snake River Junction First Filing Subdivision, recorded under Receiving # 930696 on June 26, 2007 in the Office of the Lincoln County Wyoming Clerk. e. April 13, 2007 Warranty Deed from Alpine Development Group to First Bank of Idaho for Lot 5, Snake River Junction First Filing Subdivision, recorded under Receiving # 928728 on April 24, 2007 in the Office of the Lincoln County Wyoming Clerk. f. Declaration of Covenants, Conditions and Restrictions for Snake River Junction Commercial Area, recorded under Receiving # 925354 on December 15, 2006 in the Office of the Lincoln County Wyoming Clerk. g. First Amended and Restated Declaration of Covenants, Conditions and Restrictions for Snake River Junction Commercial Area, recorded under Receiving # 932575 on August 29, 2007 in the Office of the Lincoln County Wyoming Clerk. h. Supplemental Declaration of Covenants, Conditions and Restrictions for the Snake River Junction Commercial Area, recorded under Receiving # 932982 on September 10, 2007 in the Office of the Lincoln County Wyoming Clerk. 1. Supplemental Declaration of Covenants, Conditions and Restrictions for the Snake River Junction Commercial Area (Second Filing), recorded under Receiving # 932983 on September 10,2007 in the Office of the Lincoln County Wyoming Clerk. 10. By this Affidavit, I hereby ratify and affinn that all of the documents referred to in paragraph 9 above were, on the dates of execution, signed with the full authority of Alpine Development Group, LLC through its Manager Covelop, Inc. a California corporation.
