DISTRIBUTION EASEMENT
KNOW ALL MEN BY TIlESE PRESENT:

That the undersigned, JAMES H. WA'IT8. JR., an undivided fifty percent (50%) interest as tenant· in-
common, and MALISSA ELLEN WATrS, an undivided fifty percent (50%) interest as tenant-i¡-
common, Grantees, ("Grantor") for a good and valuabl~ consideration, the receipt of which is hereby
acknowledged, do hereby grant, convey and WaJTant unto Lower Valley Energy, a Cooperative Corporatiun,
of Afton and Jackson, Wyoming and to its SUCCCSl/ors and assigns, ("Grantees"), a perpetual easement and
right of way for the construction and continued maintenance, repair, alteration and replacement of the
electric distribution circuits, lines and equipment of the Grantee to be constructed and maintained und.~r,
upon and across the premises of Grantor in LIncoln County, State of Wyoming, along a line described as
follows, to wit:
BEING a portion of Lot 3, Family Exempt Subdivision on the SW1I4NWl/4 of Section 10 and tile
SEl/4NEl/4 of Section 9 within T36N, R119W, Lincoln CO\.D1ty, Wyoming more particularly described as
follows:
COMMENCING at a point N 452 feet E, 196 feet from the W 1/4 comer of saíd Section 10. Then~e
N26QE, liS feet; thence N 46°E, 580 feet; thence N 39°E, 55 feet; thence NSSQW, 30 feet to an existing
transfonner and true point of beginning. Thence S 41 °E, 27 feet; thence S SloE, 648 feet to a point.
EASEMENT to include 10 feet on eaoh side of described line, together with all necellSary and reasonable
rights of ingress and egress and to excavate and refill ditches and trenches for the location and repair of said
facilities and to cut, trim. spray herbicides, or remove trees, shrubbery, undergrowth or other obstructions
interfering with the repair and maintenance of the facilities.
The Grantor acknowledges that Electric and Magnetic Fields (EMF) arc naturally occurring in the
transnússion or distribution of electricity, and that the Grantee has here notified Grantor that EMF testing
and infontJation is available upon request from the Grantee. This Easement by Grantor is intended :0
include so much space as is necessary or appropriate to the presence of EMF and reasonable operation .)f
the Grantee's distribution lines.
Grantor agrees that all poles, wires and other facilities, installed on or \.D1der the described lands smll
remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expens:.
The rights. conditions and provisions of this easement shall inure to the benefit of and be binding upon the
parties, their heirs, cx.ecutors, administrators, successors and assigns. Grantor shall compensate Grantee fi)r
any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees if
action is undertaken by Grantee to enforce the commitments described in this easement. Grantor reSeTVI\S
the right to improve, occupy and use this easement for an purposes not inconsistent with the easement grar t.
Each party shall have the remedy of specific perfonnance regarding this easement. The rights ar.d
obligations described in this easement shall run with the land. This easement is not exclusive, and Grantor
retains all rights not specifically granted by this easement. This is the entire agreement of the partil!S
regarding this easement, except as may be set forth in writing after the date of this easement ~d signed by
the parties. Grantor hereby releases and waives all rights by virtue of the Homestead Exemption Laws of
Wyoming. /
