EASEMENT
KNOW ~L ~N BY T~SE PRESENT:
That ~, the undersigned, GE~LD E. MOR~R and L~A G. MORTAR, as Trustees
of the Gerald E. and Linda G. Mortimer Family Living Trust, ("Grantor"), for a good and
valuable consideration, the receipt of which is hereby ac~owledged, do hereby grant, convey and
warrant unto Lower Valley Energy, a Cooperative Corporation, of~on and Jacksmx Wyo~g ~d
to its successors and assigns, ("Grantees"), a perpetual easement ~d right of way for the construction
and continued maintenance, repair, alteration and replacement of the electric distribution circuits, lines
and equipment of the Grantee to be constructed and maintained under, upon and across the presses
of Grantor in BONNE~LE County, State of ~AHO along a line described as follows, to wit:
BEING a portion of Lot 1, Block 1, Deer Creek Acres, Division No.1, Lying in Lot 5, Section
34, TiN, R44E, B.M., Bonneville County, Idaho, being more particularly described as follows:
COMMENC~G at a point being the Easterly most corner of said Lot 1, within Block 1;
Thence N 60° 53' 34" W, 15 feet to true point of beginning.
Thence S 78° W, 100 feet; thence N 56° W, 155 feet;
Thence S 34° W, 113 feet; thence S 2° W, 65 feet to a transformer location;
Thence S 33° E, 70 feet to a meter location.
EASEMENT to include 10 feet on each side of described line.
Together with all necessary and reasonable rights of ingress and egress and to excavate and refill
ditches and trench for the location and repair of said facilities and to cut, trim, or remove trees,
shrubbery, undergrowth or other obstructions interfering with the repair and maintenance of the
facilities. The Grantor acknowledges that El ectric and magnetic Fields (EMF) are naturally occurring
in the distribution of electricity, and the Grantee has here notified Grantor that EMF testing and
information is available upon request from the Grantee. The undersigned agrees that all wires and
other facilities, installed on the above described lands at the Grantee's expense shall remain the
property of the Grantee, removable at the option of the Grantee. We herebv release and waive all
rights under and by virtue of the Homestead Exemption Laws of the said State.
