VIRGINIA E. GARDNER, being first duly sworn on oath deposes and say:
1. That VIRGINIA E. GARDNER is of adult age and is the surviving wife of REED
GARDNER, who died April 1 ,2007, in Afton, Lincoln County, Wyoming, as hereinafter more fully
appears.
2. That by a Warranty Deed dated July 18, 1968, and recorded July 30, 1968 in the
office of the Lincoln County Clerk in and for the County of Lincoln, State of Wyoming, in Book
84 PR, Page 25, M. Ballard Gardner et al conveyed to Reed H. Gardner and Virginia E. Gardner,
husband and wife, by the entireties, of 83421 US Hwy 89 S., Afton, Wyoming 83110, Lincoln
County, State of Wyoming, the following described real estate situated in Lincoln County, State of
Wyoming, to-wit:

That property as more fully described on Exhibit "A", a copy of which is attached
hereto and by this reference made a part hereof.
Hereby releasing and waiving all rights under and by virtue of the homestead
exemption laws of the State of Wyoming.
3. That by a Decree Quieting Title dated November 3, 1971, and recorded November
8, 1971, in the office of the Lincoln County Clerk in and for the County of Lincoln, State of
Wyoming, in Book 96 PR, Page 81, Reed H. Gardner and Virginia E. Gardner, husband and
wife, by the entireties, Plaintiffs, v. Ezra Brown et aI, Defendants, Civil No. 4516, Third Judicial
District, Lincoln County, State of Wyoming, quieted title to Reed H. Gardner and Virgin a E.
Gardner, husband and wife, by the entireties, the following described real estate situated in Lincoln
County, State of Wyoming, to-wit:
That property as more fully described on Exhibit "B", a copy of which is attached
hereto and by this reference made a part hereof.
4. That Reed Gardner died on theIst day of April,2007, in Lincoln County, State of
Wyoming, and thereupon, the certificate of his death was duly filed with the State of Wyoming and
made a matter of record in said office, and a certified copy of said certificate is attached hereto and
made a part of this affidavit.

5. That upon the death of Reed Gardner, as aforesaid, the joint tenancy created by the
aforesaid deed and Decree Quieting Title were terminated, and Virginia E. Gardner, surviving
wife, became vested with all of his right, title and estate in the above property.
