TRUST SUCCESSION AFFIDAVIT

The undersigned successor trustee, upon oath, deposes and says as follows:
1. Glenn P. Napierskie and Virginia M. Napierskie established the Napierskie Family
Trust under agreement dated July 13, 1977, as amended and restated on July 16, 1997, as amended
August 6, 1997, as amended December 28, 1999 (hereinafter "Napierskie Family Trust").
2. Attached hereto are true and correct copies of (i) the first page and signature pages of
the Amendment and Restatement of Napierskie Family Trust dated July 16, 1997, (ii) the Fifth
Amendment of the Napierskie Family Trust dated December 28, 1999, (ill) Napierskie Family Trust
Nonjudicial Family Settlement Agreement dated April 12, 2008, and (iv) the Appointment of
Successor Trustee dated ~, showing the due execution of said trust agreement and
showing the designation of the undersigned as successor trustee thereof
3. Glenn P. Napierskie died on September 6, 2006, in Jackson, Wyoming. Attached
hereto is a copy ofhis official death certificate certified by the State of Wyoming Health Department,

the public authority with which the original death certificate is of record according to law.
4. The terms of the Napierskie Family Trust, Nonjdudical Settlement Agreement dated
Aril12, 2008, and Appointment of Successor Trustee dated ~provide that Napierskie
Fiduciary Management Corp., a Wyoming corporation would act as successor trustee upon the death
of Glenn P. Napierskie.
5. This affidavit is given pursuant to WYO. STAT. § 34-2-123 with respect to the
following described real estate:

6. By reason of the death of Glerm P. Napierskie, the undersigned became the acting
successor trustee of the Napierskie Family Trust, having all power and authority afforded to the
trustee pursuant to said trust agreement and the laws of the State of Wyoming, including the power to
mortgage, conveyor otherwise dispose of the assets of said trust, including the above-referenced real
estate or any interest therein.
