That the undersigned, JetTrey V. Roswerg and Beeky A. RolleDberg, Huband md Wife, (uGrantol")
for a good and valuable consideration, the receipt of wbich is hereby acknowledged, do hereby grallt,
convey and wamJDt unto Lower Valley Energy, a Cooperative Corporation, of Afton and Jacbcn.
Wyoming and to its successors and BSSigns, ("Grantees"), a pe¡petua1 essement and right of way for t:æ
construction and continued maintenance, repair, alteration and replacement of the electric distributi,m
circuits, lines and equipment of the Grantee to be constructed and maintained under, upon and across be
premises of Grantor in Lincoln County, State ofWyomiDg, along a line described as follows, to wit:
BEING a part of NWI/4NW1I4 of Section 36, T3IN, R119W, in Lincoln County, Wyoming more
accurately descnDed as follows:
BEGINNING 889°31 '32"W, 766 feet from the Northeast comer of said NWl/4NW/4. Thence S2°E, '10
feet, Thence 817°E, 133 feet, Thence SI2°W 221 feet. Thence S 37°E 20 feet to Point "A:., Thence S5IoW,
32 feet. Thence from Point "A" 853"E, 116 feet, Thence N88"E, 111 feet. Thence 857°E, 52 feet. Then::e
S17"E 296 feet. Thence 837"E, 78 feet. Thence 844°B, 48 feet, 888"E 52 feet, N47"W, 116 feet, Then::e
S20DE, 38 feet to a tIansfonner location.
EASEMENT to include 10 feet on each side of described line, together with all necessary and reasona1:le
rights of ingress and egress and to excavate and refill ditches and trenches for the location and repair of said
facilities and to cut, trim, spray herbicides, or remove trees. shrubbery, undergrowth or other obstructiO:lS
interfering with the repair and maintenance of the facilities.
The Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occurring in t:æ
transmission or distribution of electricity, and that the Grantee has here notified Grantor that EMF testÍ;1g
and infonnation is available upon request from the Grsntee. This Easement by Grantor is intended to
include so much &pace as is necessary or appropriate to the presence of EMF and reasonable operation of
the Grantee's distribution lines.
Grantor agrees that all poles, wires and other facilities, installed on or under the described . lands shill
remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expemiC.
The rights, conditiODB and provisions of this easement shall inure to the benefit of and be binding upon ÍJe
parties, their heirs, executors, administrators, successors snd I198igns. Grantor shall compensate Grantee fOr
any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees if
action is undertaken by Grantee to enforce the commitments described in this easement. Grantor reserves
the right to improve, occupy and use this easement for all purposes not inconsistent with the easement grant.
Each party shall have the remedy of specific perfomumce regarding this easement The rights and
obligations described in this easement shall run with the land. This easement is not exclusive, and Grantor
retains all rights not· specifically granted by this easement This is the entire agreement of the parties
regarding this easement, except as may be set forth in writing after the date of this easement and signed ',y
the parties. Grantor hereby releases and waives all rights by virtue of the Homestead Exemption Laws of
Wyoming.
