Easement for Longhurst Irrigation Ditch

In accordance with the Agreement between F. Bryant Gomm and Robert M. Longhurst in
settling property rights dated 9/18/08, an irrigation easement, 10 feet wide, along the existing ditch
which lies across Tract B within Section 17 T30N Rl18W GLO Lot 4, as shown on that plat with
instrument No 657911 is hereby granted by Fred Bryant Gomm and Dorothy Ann B. Gomm, acting as
managers for Gomm Ranch LLC as the first part to Robert M. Longhurst and Nola C. Longhurst,
acting as trustees for the Robert M. Longhurst and Nola C. Longhurst Trust as the second part, under
the following conditions to wit:
1. By way of this easement right-of-way, the first part grants to the second part the right to ingress
and egress across Tract B in order to service water rights and maintain the delivery ditch. The
easement does not transfer ownership of the land property.
2. Both parties agree to communicate in ditch maintenance so that any maintenance on ditch is
approved by both parties.
3. This easement shall be binding upon the heirs, adminstrators, and assigns of both parties.
