All of the above heirs have entered into a an agreement entitled Estate of Fred Daly (sic) Pyle, Jr. Beneficiary Agreement, wherein all of the heirs have agreed that the above described mineral interest should be transferred and set over to Susan Marie Bennett, as Trustee of the Fred Dale Pyle, Jr. Trust Restatement, dated May 23, 2002, as amended in the 1 st Amendment to the Restatement of Trust, dated October 31,2005, which trust is more formally known as Susan M. Bennett, Trust Manager of the Fred D. Pyle Trust, dated Apri124, 1990. A true and correct copy of the Estate of Fred Daly (sic) Pyle, Jr., Beneficiary Agreement is filed herein. 6. As a result of the above referenced agreement, the sole heir of the estate of Fred D. Pyle, Jr., is as follows: Name, Address, and Relationship Age Share Susan M. Bennett, Trust Manager of the Fred D. Pyle, Jr. Trust, dated April 24, 1990, and any amendments thereto. N/A All 7. That the value of the entire estate, wherever located, less liens and encumbrances, does not exceed One Hundred Fifty Thousand and NollOO Dollars ($150,000.00), and a Report of Appraisal is filed herein with respect to the real property contained in the above-entitled estate. 8. That thirty (30) days have elapsed since the death of the decedent. 00û798 9. That no application for appointment of a Personal Representative is pending or has been granted in any jurisdiction. 10. That by virtue of the matters contained herein, Susan M. Bennett, Trust Manager of the Fred D. Pyle, Jr. Trust, dated ApriJ 24, 1990 is entitled to payment or delivery of the property of said decedent, and there are no other distributees of the decedent having a right to succeed to the property under probate proceedings. IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that Susan M. Bennett, Trust Manager of the Fred D. Pyle, Jr. Trust, dated April 24, 1990 be and she is hereby, determined to be the beneficiary of the estate of Fred D.
