Brown and Bonnie J. Brown established the Maurice W. Brown and Bonnie J. Brown Irrevocable Trust dated December 26, 1979, under which First Wyoming Bank, N.A., was the Trustee; and WHEREAS, under the tenns of the Maurice W. Brown and Bonnie J. Brown Irrevocable Trust agreement, the assets of the Trust were to be divided into three (3) equal separate shares and each share shall be held by the Trustee as a separate trust; one (1) share each for the benefit of Alicia J. Brown, Russell W. Brown, and Laurie A. Brown; and WHEREAS, under the tenns of that Trust, upon Alicia J. Brown reaching the age of thirty-five (35), the Trustee distributed to her all of the property then belonging to her separate Trust; and WHEREAS, under the tenns of that Trust, upon Russell Brown reaching the age of thirty-five (35), the Trustee shall distribute to him all of the property then belonging to his separate Trust; and IT is the intention of the Trustee to distribute to Russell Brown, all of the overriding royalty interest held in his separate Trust, which is to say, ONE-HALF (112) of the current overriding royalty interest held in the Maurice W, Brown and Bonnie J. Brown Irrevocable Trust dated December 26, 1979. THEREFORE, in consideration of the sum of TEN DOLLARS ($10.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, the undersigned, I BANK OF THE WEST, SUCCESSOR BY MERGER TO FIRST WYOMING BANK, N.A., TRUSTEE OF THE MAURICE W. BROWN AND BONNIE J. BROWN IRREVOCABLE TRUST, hereinafter called ASSIGNOR, do hereby assign, transfer and deliver unto: -:'1- j Russell Brown 9240 W. Hwy 220 Casper, WY 82604 hereinafter called ASSIGNEE, ONE-HALF (112) of all of the overriding royalty interest which may be produced, saved and marketed from the properties covering lands described below, situated in Lincoln County, Wyoming., to-wit: Lease Serial No. Description of Land Subject to Lease 71-14804 All of Section 36, Township 20 North, Range 113 West, 6th P.M. THIS ASSIGNMENT IS MADE WITHOUT ANY WARRANTY OF TITLE, EXPRESS OR IMPLIED.
