MODIFICATION OF MORTGAGE
THIS MODIFICATION OF MORTGAGE dated December 9, 2008, is made and executed between JOSEPH GABRIEL
KALUS, IV, AS SOLE OWNER, whose address is POBOX 1513, AFTON, WYOMING 83110 (referred to below as
"Grantor") and JONAH BANK OF WYOMING, whose address is 777 WEST FIRST STREET, CASPER, WY 82601
(referred to below as "Lender").
MORTGAGE. Lender and Grantor have entered into a Mortgage dated May 20, 2008 (the "Mortgage"' which has been recorded in LINCOLN
County, State of Wyoming, as follows:
RECORDED WITH LINCOLN COUNTY CLERK ON MAY 22,2008 AS INSTRUMENT NO. 939202, BOOK 695, PAGE 221.
REAL PROPERTY DESCRIPTION. The Mortgage covers the following described real property located in LINCOLN County, State of Wyoming:
LOT 37 OF AFTON AIRPARK ADDITION TO THE TOWN OF AFTON, LINCOLN COUNTY, WYOMING AS DESCRIBED ON THE OFFICIAL
PLAT NUMBER 167-C FILED AUGUST 1, 2005 AS INSTRUMENT NUMBER 910442 OF THE RECORDS OF THE LINCOLN COUNTY CLERK
The Real Property or its address is commonly known as 95 ECLIPSE STREET, AFTON, WY 83110. The Real Property tax identification number
is 1232193640008700.
MODIFICATION. Lender and Grantor hereby modify the Mortgage as follows:
THE PRINCIPAL AMOUNT OF THE INDEBTEDNESS IS HEREBY INCREASED TO $496,000 FROM $417,000.
CONTINUING VALIDITY. Except as expressly modified above, the terms of the original Mortgage shall remain unchanged and in full force and
effect and are legally valid, binding, and enforceable in accordance with their respective terms. Consent by Lender to this Modification does not
waive Lender's right to require strict performance of the Mortgage as changed above nor obligate Lender to make any future modifications.
Nothing in this Modification shall constitute a satisfaction of the promissory note or othsr credit agr99msnt secursd by the Mortgags (the
"Note"'. It is ths intsntion of Lsnder to rstain as liabls all parties to the Mortgage and all parties, makørs and endorsers to the Note, including
accommodation parties, unless a party is expressly released by Lender in writing. Any maker or endorser, including accommodation makers,
shall not be released by virtue of this Modification. If any person who signed the original Mortgage does not sign this Modification, then all
persons signing below acknowledge that this Modification is given conditionally, based on the representation to Lender that the non-signing
person consents to the changes and provisions of this Modification or otherwise will not be released by it. This waiver applies not only to any
initial extension or mOdification, but also to all such subsequent actions.
GRANTOR ACKNOWLEDGES HAVING READ ALL THE PROVISIONS OF THIS MODIFICATION OF MORTGAGE AND GRANTOR AGREES TO ITS
TERMS. THIS MODIFICATION OF MORTGAGE IS DATED DECEMBER 9,2008. .
