HomeMy WebLinkAbout945369 AFFIDAVIT OF PARTIAL VACATION OF ROADWAY 60ö66:1 KNOW ALL BY THESE PRESENTS, that the Shooting Star Subdivision Home Owner's Association gives notice and desires to vacate a certain portion of Shooting Star Drive of the Shooting Star Subdivision of Lincoln County, Wyoming. That the partial vacation was authorized by the necessary two thirds (2/3) majority of lot owners in the subdivision. Said vacated portion is hereafter described and reflected as Exhibit" 1" of the Subdivision map attached hereto and made part hereof, 1. Said portion of the roadway to be vacated is described as follows: That portion of Shooting Star Drive lying westerly ÍÌ"om the 67.08 foot radius cul-de-sac common to lots 18 and 19 which abuts lots 15 and 17 on the Shooting Star Subdivision Platt as recorded and reflected on Exhibit "1"; also being described as the Westerly 615.08 feet, more or less, of the said roadway, 2, Said roadway is a private road with right of use granted to each lot owner to include utilities and the Bedford Canal and other adjudicated water rights. The vacating portion is the roadway, the grant for utilities , the Bedford Canal and other adjudicated water rights to remain. 3. The Affidavit, being duly sworn, is the result of a vote of all the owners of subdivision lots, who have an interest in the roadway as certified by the Secretary/Treasurer ofthe Shooting Star Subdivision Home Owner's Association and by their vote consent to the partial vacating of the roadway. 4. Said Affidavit, hereby vacates that portion of Shooting Star Drive referred to in the aforesaid description, requesting the County Clerk to make the appropriate notation on the recorded platt as reflected on the attached Exhibit" 1" and recorded hereby. 5. By vacating the said portion of the roadway, there are no rights without consent that are destroyed or abridged to other proprietors in the Shooting Star Subdivision Platt, 6. It is specifically the intent not to vacate the rights of use for utilities, the Bedford Canal and other adjudicated water rights; said right shall continue unchanged. 7. Votes were cast in person and by proxy, four other votes were cast in a follow up canvass.
