PERPETUAL ROADWAY EASEMENT

WHEREAS the Board of Land Commissioners approved this grant of easement on June 5, 2008;

THEREFORE, the State of Wyoming, acting through its Board of Land Commissioners (Grantor), for and in
consideration of the payment of One thousand two hundred sixty-eight & nolI 00 dollars ($1,268.00) hereby grants and
conveys to Lorain J. Bagley and Geraldine R. Bagley Revocable Trust (Grantee). their heirs. administrators. successors.
executors, legal representatives. and assigns for perpetual use, in the following described tract of land, a non-exclusive
roadway. more particularly described as follows:
All that portion of the SE4SE4 of Section 16. T.31N., R.119W., of the 6th P.M.. Lincoln County,
Wyoming, said access road easement being 30 feet wide. being 15 feet on each side when measured at
right angles as described on the attached exhibits. The described parcel ofland contains 0.57 acres. more
or less.

These descriptions are based on a survey done by and under the authority of, Marlowe A. Scherbel with
Wyoming PLS No. 5368, certified in October 2008.
This roadway easement shall benefit and provide ingress and egress to the following described property for
a single family dwelling(s) and for agricultural and ranching purposes:
Township 31 North, Range 119 West
Section 15: SW4
TO HA VB AND TO HOLD this easement across the above-described tract ofland for the purpose oflocating.
constructing, using, inspecting. maintaining, improving, and repairing the above-described non-exclusive roadway,
subject to the following conditions:
1. The rights granted herein shall forever be subjectto the rights of the Grantor. its assigns or lessees to explore
for, develop. and extract any and all minerals or other subsurface resources beneath this easement. If required
for mineral exploration, development or extraction, the Grantee shall, upon written notice fÌ'Om the Grantor.
remove or relocate at its own expense the above-described roadway.
2. Upon abandonment or discontinuance of use of this easement for the purposes specified above, all of
Grantee's rights under this grant of easement shall revert to the Grantor or its assigns. the same as if this grant
had never been made. Should this easement be abandoned by the Grantee. the above-described tract ofland
shall be returned to a condition satisfactory to the Grantor.
3. This easement does not include the right to make use of the road for residential developments.
4. For record keeping purposes only. any transfer in ownership of the benefited property. or any change of
name or mailing address of the owner of this easement, shall be reported to the Office of State Lands and
Investments within thirty days (30) of the transfer or change.
The State of Wyoming and the Board of Land Commissioners do not waive their sovereign immunity by
entering into this agreement and specifically retain immunity and all defenses available to them as sovereigns
pursuant to Wyo. Stat. § 1-39-104(a) and all other law.

A strip of land thirty (30) feet in width being part of the SEV,¡SEY4 of Section 16, T31N,
R119W, Uncoln County, Wyoming, described as follows:
BEGINNING at the southeast comer of said Section 16;
thence NOoo-31 '-36"E, 836.9 feet, more or less, along the east line of said SEV,¡SEV,¡, to the
southerly right-of-way line of the Fairview - Spring Creek County Road No. 12-144;
thence S52°-32'-55"W, 38.06 feet, along said southerly right-of-way line, to a position;
thence SOoo-31' -36"W, 813.9 feet; more or less, along a line parallel with and thirty (30)
feet westerly of said east line, to the south line of said Section 16;
thence N89°-38'-59"E, 30.00 feet, along said south line, to the CORNER OF
BEGINNING;
that it is the intent of this description to describe that part of the east thirty (30) feet of said
SEV,¡SEV,¡ lying and being situate southerly of the Fairview - Spring Creek County Road
No, 12-144;
that the above described easement is appurtenallt to those tracts of rccord in the Office of
the Clerk of Lincoln County in Book 344 of Photostatic Records on page 479 within the
SY2SWV,¡ of Section 15 and in GLO Lots 1 and 2 of Section 21 and GLO Lots 1 and 2 of
Section 22, T31N R119W, Lincoln County, Wyoming;
each "comer" found as described in the Comer Record filed in the Office of the Clerk of
Lincoln County;
all in accordance with the attached plat titled, "PLAT TO ACCOMPANY APPLICATION
FOR LORAIN J. BAGLEY AND GERALDINE R. BAGLEY REVOCABLE TRUST,
