AN ORDINANCE ANNEXING THE SWI/4NW1/4 OF SECTION 6, T3IN RII8W, IN
LINCOLN COUNTY, WYOMING, DESCRIBED AS THE MOUNTAIN INN ANNEXATION
TO THE TOWN OF AFTON.
BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF AFTON:
WHEREAS, the Governing Body has reviewed a petition to annex the propeliy
hereinafter described into the Town of Afton by a majority of the landowners owning a majority
of land in the area sought to be annexed.
WHEREAS, the Govel11ing Body ofthe Town of Afton has found that:
1. A notice of heming on the proposed annexation was published in the Star Valley
Independent not less that thiIiy (30) days prior to the date of the public hearing;
2. A copy of the published notice was sent to each propeliy owner owning propeliy
within the area sought to be annexed;
3. The petition for annexation is signed by a majority of owners owning a majority
of the area sought to be annexed;
4. The annexation of the area hereinafter described is for the health, safety, and
welfare of the persons residing in the area sought to be annexed;
5. The area sought to be annexed would constitute a natural, geographical,
economical, and social pmi of the Town of Afton;
6. The area sought to be annexed is a logical and feasible addition to the Town of
Afton and extension of the basic and other services continuously available to
residents of the Town of Afton can reasonably be ful11ished to the area sought to
be annexed;
7, The area sought to be annexed is contiguous or adjacent to the Town of Afton;
8. CUl1'ently, the propeliy owner in the area sought to be annexed is not connected to
the municipal water and sewer system. Before any development of the
subdivision can occur, water and sewer will need to be available for each lot
before any phase of the subdivision can be approved;
9. The Govel11ing Body is prepared to issue such franchises as are necessary to
public electric utilities to serve the annexed area;

This propeliy will be zoned (C-2), Commercial;

NOW, THEREFORE, BE IT ORDAINED by the Goveming Body of the Town of Aft on
that:
1. The area described in the petition of Mountain Inn be annexed to the Town of
Afton.
2. The Town limits be expanded to reflect the annexation.
3. All issues peliaining to water and sewer services to the m'ea proposed to be
annexed will be resolved before final enactment of the annexation.
4. The developer will be responsible for the construction and installation of all
utilities in the event that the Town of Afton is unable to obtain a grant from the
State of Wyoming or the Federal Govemment to cover the costs.
5. The developer will cover any deficiency or remaining amount of fees not covered
by the grant.
6, The developer will provide all required easements and right of ways on the
propeliy to the Town of Afton.
