Box 45360, Right-of-way Salt Lake City, UT 84145-0360 5331Diamond.cp; RW01 RECEIVED 5/20/2009 at 11:49 AM RECEIVING # 947274 BOOK: 723 PAGE: 381 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY 0®0381 Space above for County Recorder's use PARCEL I.D.# 2116252117600 RIGHT-OF-WAY AND EASEMENT GRANT WY #05331 TOWN OF DIAMONDCILLE WYOMING , Grantor, does hereby convey and warrant to QUESTAR GAS COMPANY, a corporation of the State of Utah, Grantee, its successors and assigns, for the sum of ONE DOLLAR ($1.00) in hand paid and other good and valuable consideration, receipt of which is hereby acknowledged, a right-of-way and easement to lay, maintain, operate, repair, inspect, protect, remove and replace pipelines, valves, valve boxes and other gas transmission and distribution facilities (hereinafter collectively called "facilities"), said right-of-way being situated in the County of Lincoln, State of Wyoming, and more particularly described as follows, to-wit: Land of the Grantor located in the Northwest Quarter of Section 25, Township 21 North, Range 116 East, of the 6th Principal Meridian; Beginning at a point on the North boundary of Lot 1 in Tomassi Addition, being part of the Northwest Quarter of Section 25, Township 21 North, Range 116 West, of the 6th Principal Meridian, in Diamondville City, Lincoln County, Wyoming, a replat of the 1942 Plat of the Town of Diamondville, Wyoming, said point of beginning also being North 78°57'53" East 306.84 feet along the South boundary of said Lot 1, and North 11 °02'07" West 108.66 feet from the Southwest corner of said Lot 1 in Tomassi Addition; and running thence North 80°57'28" West 326.69 feet; thence North 11°02'07" W 2.89 feet; thence North 78°57'53" East 79.48 feet along the North boundary of said Lot 1; thence South 80°57'28" East 208.50 feet; thence along the Northeast boundary of said Lot 1 and Southeasterly 53.82 feet along the arc of a 223.70 foot radius curve to the right through a central angle of 13°47'06" (Long Chord bears South 46°59'20" East 53.69 feet from the beginning of the curve), to the point of beginning. (0.1883 Acres) Page 1 of 2 TO HAVE AND TO HOLD the same unto said QUESTAR GAS COMPANY, its successors and assigns, so long as such facilities shall be maintained, with the right of ingress and egress to and from said right-of-way to maintain, operate, repair, inspect, protect, remove and replace the same. During temporary periods, Grantee may use such portion of the property along and adjacent to said right-of-way as may be reasonably necessary in connection with construction, maintenance, repair, removal or replacement of the facilities. Grantor shall have the right to use said premises except for the purposes for which this right-of-way and easement is granted to Grantee, provided such use does not interfere with the facilities or any other rights granted to Grantee hereunder. 000382 Grantor shall not build or construct, nor permit to be built or constructed, any building op over or across said right-of-way, , without written consent of Grantee. This easement is not an exclusive easement and Grantor has existing public utilities adjacent to, and possibly within the easement boundary as described. Grantor retains all its rights and responsibilities to install, operate, maintain, repair, inspect, protect, remove and replace its public utilities which may be within this easement and Grantor's rights to do so shall remain the dominate estate over the easement hereby granted. This right-of-way shall be binding upon and inure to the benefit of the successors and assigns of Grantor and the successors and assigns of Grantee, and may be assigned in whole or in part by Grantee. It is hereby understood that any parties securing this grant on behalf of Grantee are without authority to make any representations, covenants or agreements not herein expressed.
