That the Mortgagor and maker of the underlying note have failed to pay the principal and interest, when the same became due and payable, and in this, and otherwise, have defaulted in the performance of the conditions and terms of the mortgage held by Wells Fargo Bank, National Association (`Bank"). The Bank has elected to declare the entire balance due and payable and to exercise the power to foreclose the mortgage by advertisement and sale as provided in the mortgage. 2. That no suit has been instituted at law to recover the balance of the debt secured by the mortgage. 3. That the mortgage containing the power of sale has been duly recorded. 4. That written notice by certified mail with return receipt of the intent to foreclose by advertisement and sale has been mailed to the last known address of the Mortgagor, the record owners, and the persons in possession of the mortgaged property, if any, other than the Mortgagor, at least ten (10) days before the commencement of publication of notice of sale. 5. The property which is the subject matter of this foreclosure is described as follows: Lot 48 of the REES Subdivision, being part of the North Half of the Southeast Quarter (N 1/z SE 1/4) of Section 20, Township 37 North, Range 118 West, Lincoln County, Wyoming, according to that plat recorded in the Office of the Lincoln County Clerk as Plat No. 171 ("Property") 6. Affiant is an attorney admitted generally to practice law in the State of Wyoming and represents Bank, the holder of the mortgage. There has been and is no agreement, express or implied, between affiant and, or any other person for any sharing or division of the attorney's fee to be allowed or added to the debt involved and said attorney's fee shall be only as compensation for services actually rendered in the foreclosure proceeding by affiant. 7.
