KNOW ALL MEN BY THESE P~SENT: ....
That we, the undersigned CALVIN R. BI~EY and SHE~Y L. BI~NEY (Grantors), for a good and
valuable consideration, the receipt of which is hereby ach~owledged, do hereby grant, convey and warrant unto
Lower Valley Energy, a Cooperative Corporation, of Alton and Jackson. Wyoming and to its successors and
assigns (Grantees), a perpetual easement and right of way for the construction and continued maintenance.
repair, alteration and replacement of the electric trm:smission hcilities and related state of the art technologicai
improvements in service to members, of the Grantee, to be constructed and maintained under, over, upon and
across the premises of Grantor in Lincoln County, State of Wyoming, along a line described as Gllows, to wit:
BEING part of Lot 26 of Broken Wheel Rauch Subdivision, (said subdivision being the SW
Section 15, T. 36 N., R. 119 W. of the 6th P.M~ Wyoming) m accordance with the official plat filed
February 2~ 1972, in the Office of Coun~ Clerk, Lincoln County, Wyoming.
BEGINNING at a brass cap marking the NE 1/16 Corner of Section 15, T. 36 N., R. 119 W., thence S
00° 22' 32" E, 247 feet, thence S 35° 10' W, approximately 29 feet, Thence easement begins and bears
approximately N 13° 30' W, 278 feet to a point on the north lot bounda~,, said point being 80 feet more
or less from the northeast lot corner,
EASEMENT includes 50 feet each side of the descried centerline. This easement, in conjunction with
the adjacent platted road and utiliD, easement, replaces an easement reco~ed iu Book 18PR, Page220,
granted to Lower Valley Power and Light by Ardell Ames, 14 May, 1956,
Together with all necessary and reasonable rights of ingress and egress and to excavate and refill ditches and
tren Ches for the location and repair of said hcilities located within this easement an d to cut, trim, otherMse
control, or remove trees, shrubbery, undergrowth or other obstructions within 50 feet of the centerline of the
transmission hciliti~ or improvements which interfere with or threaten to interhce with or endanger the
operation, repair, or maintenance of said hciliti~. The Grantor acknowledges that Electric and Magnetic
Fields (EMF) are naturally occurring m the transmission of electricity, and the Grantee has here notified
Grantor that EMF testing and information is available upon request from the Grantee, This Easement by
Grantor is intended to include so much space as is necessary or appropriate to the presence of EMF and
reasonable operation of the Grantee's transmission lines.
The nndersigned agrees that all poles, wires and other hcilities, installed on the above described lands at the
Grantee's expense shall remain the property of the Grantee, removable in the sole discretion of the Grantee,
We hereby release and waive all rights under and by vi~lue of the Homestead Exe~nption Laws of the said
State.
