HomeMy WebLinkAbout949676QUIT CLAIM DEED KNOW ALL MEN BY THESE PRESENTS: That the Town of Diamondville, an incorporated Town of the County of Lincoln, State of Wyoming, Grantor, for and in consideration of the sum of Ten and No/ 100 Dollars ($10.00) and other valuable consideration in hand paid, receipt of which is hereby acknowledged, has hereby remised, released and forever quitclaimed unto the said Frank & Janice Zurita, their heirs and assigns forever, all such right, title, interest, property, possession, claim and demand, as they may have or ought to have in or to all the following described property, to-wit: A parcel of land being part of dedicated West Hillcrest Drive (formally First West Avenue) in the Hillcrest Addition of the 1942 plat of the Town of Diamondville, Wyoming and being more particularly described as follows: Beginning at the Southeasterly most comer of Lot 2, Block 1 of the Hillcrest Addition to the Town of Diamondville, Wyoming. Said point being a point on the North Boundary line of West Hillcrest Drive: Thence S 44°0614" W along a line being the extension of said North Boundary of West Hillcrest Drive and the South Boundary of Lot 1, Block 1 of said Hillcrest Addition a distance of 60.00 feet To a corner of Lot 3, Block 1 of said Hillcrest Addition. Said point being a point on the North Boundary line of West Hillcrest Drive. Thence 47.12 feet Northeasterly along the arc of a curve to the right and the East Boundary line of Said Lot 3 to the common corner of said Lot 2 and Lot 3. Said curve to the right having a central Angle of 90°0600" and a radius of 30.00 feet; Thence continuing 47.12 feet along the arc of said curve to the right and the Southerly Boundary line of said Lot 2 to the point of beginning. Said curve to the right having a central angle of 90°0000" and a radius of 30.00 feet. Said parcel contains 1414 square feet more or less. SUBJECT, HOWEVER, to all easements, restrictions, reservations, exceptions and rights-of-way on record or in use. Dated this 8th day of September 2009. WITNESS my hand and official seal ~ duo O ARY P My Commission Expires: RECEIVED 9/24/2009 at 10:47 AM Of RECEIVING # 949676 BOOK: 732 PAGE: 482 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY RESOLUTION 2009-44 483 WHEREAS, on July 6`", 2009 a petition was filed with the Town Council of the Town of Diamondville, County of Lincoln, State of Wyoming, by a majority of the adjoining property owners and praying said Town Council to vacate that portion of West Hillcrest Drive (Formally First West Avenue) south of Lot 2 Block 1 as identified in Attachment A which is made a part of this resolution by this reference as though recited herein word for word; and WHEREAS, according to the minutes of the Town of Diamondville, it having been shown to said Council by satisfactory evidence that the portion of said street to be vacated has been used by the public, but the same is not necessary for use by the public; and WHEREAS, this matter having been duly noticed for public hearing and that hearing having taken place on September 8, 2009; and no one having objected to the vacation of that portion of West Hillcrest Drive, south of Lot 2 if Block 1 as identified in Attachment A and approved the Mayor and Clerk to issue the deed to the adjoining property owner with a motion by Council Member ~Jand second by Council jgXAaU&_; ;and WHEREAS, the present Council has reviewed this matter and is of the opinion that the proper procedure was followed with the exception of a resolution being passed and recorded. BE IT HEREBY RESOLVED that the Town Council of the Town of Diamondville hereby confirm and ratify the vacating that portion of West Hillcrest Drive south of Lot 2 of Block 1 and the issuance of the proper deed to the adjoining owner.
