HomeMy WebLinkAbout95014100CA24 RECEIVED 10/22/2009 at 4:10 PM RECEIVING # 950141 BOOK: 734 PAGE: 424 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY LOAN MODIFICATION AGREEMENT This agreement is made and entered into between First International Bank & Trust, the "Bank", and Signature Investments, LLC, A North Dakota Limited Liability Company, the "Borrower(s)". The Bank is the holder of a note # 160234 mortgage and assignment of leases and rents, incorporated in this agreement by reference, executed on October 13, 2006, as evidence of and security for a loan made to the Borrower by the First International Bank & Trust on October 13, 2006. The Borrower is now indebted to the Bank in the sum of $550,451.29. $546,501.69 consisting of principal and $3,749.60 consisting of interest and as of this date and no unpaid installments of ground rents, hazard insurance premiums, taxes, assessments, and mortgage insurance premiums, the payment of which is secured by a Note, Mortgage, and Assignment of Leases and Rents owned and held by the Bank dated October 13, 2006 and recorded in the office of Lincoln County Clerk, Kemmerer, Wyoming on November 7, 2006 as Receiving #924161, Book 639 and Page 519 and An Assignment of Leases and Rents with a Receiving #924162, Book 639 and Page 527. The Mortgage and Assignment of Leases and Rents covers the following described real property: Lot 94 in Alpine Village Subdivision No. 1, Plat 2 Amended I Ith Filing, Lincoln County, Wyoming as Described on the Official Plat Thereof A Condominium Development which is known as Lake View Villas Condominiums sits on Top of Lot 94. Formally known as at the time of our recording Lot 82 in Alpine Village Subdivision No. 1 Plat 2 Amended 6`h Filing, Lincoln County, Wyoming as Described on the Official Plat Thereof. The parties mutually desire and agree to modify the following terms and conditions and will become effective on the date this document is executed by all partners: The maturity date will be extended from October 11, 2009 to July 11, 2010. The interest rate will change from New York Prime + I% variable changing daily with a floor of 6.50% to New York Prime + 2.00% variable changing daily with a floor of 6.70%. Monthly interest payments will continue to be due on the 111' of each month starting with the November 2009 payment. All other terms and conditions will VV425 remain the same. The Mortgage shall continue as a first lien upon the premises and neither the obligation evidencing this indebtedness nor the mortgage securing the same shall in any way be prejudiced by this Agreement, but the obligation and Mortgage and Assignment of Lease and Rents and all covenants and agreements thereof and the rights of the parties thereunder shall remain in full force and effect except as herein expressly modified.
