This Acknowledgement of Easement Rights is made by Alpine Junction, LLC, a
Wyoming limited liability company "Alpine Junction for the benefit of the Alpine Meadows
Property Owners Association, a Wyoming nonprofit corporation "Alpine Meadows POA
WHEREAS Alpine Junction, as "Founder owner and developer of the Alpine Meadows
Subdivision according to that plat recorded in the Office of Lincoln County Clerk, Lincoln
County, Wyoming as Plat No. 206 -A executed the Amended and Restated Declaration of
Covenants, Conditions and Restrictions for Alpine Meadows "CC &Rs which were recorded
in the Office of the Lincoln County Clerk on October 6, 2006 as Receiving 923138;
WHEREAS the Alpine Meadows Subdivision is subject to the CC
WHEREAS Alpine Junction reserved for itself in paragraph 12.2(b) of the CC &Rs and
granted to the Alpine Meadows POA and all utility providers:
perpetual non exclusive easements within the Road Lots, the Roadway System
and easement areas described on the Plat for the Properties) but not through a
structure) to the extent reasonably necessary for the purpose of:
(i) Installing utilities, roadways and other infrastructure, including
without limitation, cable and other systems for sending and receiving data and/or
other electronic signals; security and similar systems; roads, walkways, pathways
and trails; drainage systems and signage; to serve the Properties;
(ii) Inspecting, maintaining, repairing and replacing such utilities and
infrastructure to serve the Properties; and
(iii) Access to read utility meters.
"Easements Rights
WHEREAS Alpine Junction is in the process of transferring to Alpine Meadows POA the
Road Lots (as defined in the CC &Rs) and the roads and pathways located within the Alpine
Meadows Subdivision;
WHEREAS some of the roads and pathways located within Alpine Meadows Subdivision
are located within roadway and pathway easements as shown on the Alpine Meadows
Subdivision plat; and
WHEREAS Alpine Junction wishes to acknowledge that Alpine Meadows POA has
easements for such roads and pathways.
NOW, THEREFORE, for good and valuable consideration, receipt of which is hereby
acknowledged, Alpine Junction does hereby acknowledge Alpine Meadows POA's Easement
Rights as granted by paragraph 12.2(b) of the CC &Rs.
