HomeMy WebLinkAbout952398I the undersigned Harriet Natter (Grantor) for and in consideration of Ten Dollars ($10.00) and other valuable consideration, receipt of which is acknowledged, grant, convey and warrant unto Harriet Natter, of Park City, Utah and successors and assigns (Grantee) the following described perpetual right -of -way easement: 1. Purpose of Easement. This easement is for the purpose of providing a perpetual right -of -way for ingress and egress and all utilities including the right to construct and maintain; 1) a roadway to provide ingress and egress, 2) above ground or underground utilities and related structures, and 3) fencing at the perimeter of the easement or within the easement. However, this easement is not for the purpose of providing or creating a public right -of -way. 2. Conditions of this Easement. The grantee may install fencing on the easement boundary or within the easement. The grantor may not install fencing or any other structure within the easement. Nor shall the grantor place or discard within the easement any materials, waste, soil, rock, vegetation etc. The grantor acknowledges that fencing, structures or infrastructure installed within the right -of -way at the grantee's expense shall remain the property of the grantee. 3. Property Benefited by Easement. This easement is for the perpetual benefit of Lot 15 Unit C -1, Commissary Ranch Subdivision, Lincoln County, Wyoming, as described on the official plat thereof. 4. Description of Easement. A perpetual easement and right -of -way on, over, under, above and across a parcel of land, situate in the Lincoln County, State of Wyoming, located in Lot 16 of Unit C -1, Commissary Ranch Subdivision described on the official plat thereof, and is more particularly described as follows; Beginning at the Southeast corner of Lot 16: Thence northerly along the east lot line of Lot 16, 80 feet; Thence westerly parallel to the south lot line of Lot 16, 200 feet; Thence southerly parallel to the east lot line of Lot 16, approximately 80 feet, to a point on the south lot line of Lot 16; Thence easterly along the south lot line of Lot 16, approximately 200 feet, to the point of beginning. Containing approximately 0.367 acres 5. Binding Effect. The terms and conditions of this easement shall be binding upon and inure to the benefit of the heirs, successors in interest and assigns of the parties named in this instrument. 6. Waiver of Homestead Rights. The grantor hereby waives and releases all rights to the described easement under and by virtue of the homestead exemption laws of the State of Wyoming to the extent that such rights may interfere with the purposes of this easement.
