the following described non exclusive, perpetual right -of -way easement for the following purposes:
1. Purpose of Easement. This easement is for the purpose of providing a perpetual
non exclusive right -of -way easement for ingress and egress and all underground utilities to the
property described in Paragraph 3 including the right to install, construct, reconstruct, repair,
replace and maintain a roadway and all underground utilities, and including the right to inspect the
easement.
However, this Easement is not for the purpose of providing or creating a public right
of way or access to any public lands.
2. Conditions of this Easement. The conditions of this easement are:
a. It is a common easement for the mutual benefit of all Grantees and
their respective lands.
b. Because their lands have another separate access to the Bitter Creek
County Road, this easement is granted for the benefit of the Fullmer,
Allred, Castle Rock, Kennedy, Hammond, Custom Construction,
Deardon /Harris and Sangam real property as described below solely
for the purpose of providing access for emergency purposes only
between those lands and the Bitter Creek County Road. Emergency
purposes are defined as medical emergencies, fire, earthquake, or
flooding.
c. If any Grantee disturbs the existing road through use of, construction
on or installation of utilities in the road, that Grantee shall upon
completion of such use, construction or installation, immediately
return the road to its previous condition.
d. Grantees shall be responsible for and pay all costs of maintaining the
portion of the easement which the Grantee must cross to reach
Grantee's property. In the event that multiple Grantees are
responsible for the cost to maintain the easement, said costs to be
divided equally amongst those Grantees.
e. Any and all utilities installed in the easement by Grantees shall be
underground.
f. Grantees shall hold Grantors harmless from any liability, injury,
damage or claim by any person whomsoever using or traveling upon
the roadway, whether or not such use is with or without the
permission, consent or knowledge of the Grantees; excepting,
however, any such claim arising from the use of the roadway by the

Grantors or by persons using the roadway with the express
permission of the Grantors, to include any such use pursuant to the
grant of a subsequent easement by the Grantors.
Execution and recording of this easement releases any and all
restrictions on the division or subdivision of land that may be found in
that certain Easement dated September 29, 1995, and recorded in
the office of the Lincoln County Clerk on January 19, 1996, in Book
379PR, page 188, and in that certain Easement dated April 29, 1996,
and recorded in the office of the Lincoln County Clerk on August 29,
1997, in Book 401 PR, page 52.
3. Property Benefited by Easement. This easement is for the benefit of the following
described real property of the grantees in Lincoln County, Wyoming:
Hogan Real Property
See "Description: Hogan 385 -447 Adjusted," and document 000736 attached hereto
as Exhibit A and incorporated herein by reference.
Stoker Real Property
SE1 /4NW1/4 and E1/2SW1/4 in Section 27; NE1 /4NW1/4 in Section 34, all in
T31N, R119W of the 6th P.M., Wyoming.
Doherty Real Property
See Description for James Ivan Ridge Trust, A Revocable Living Trust, U /A/D Dated 21
December 1999, attached hereto as Exhibit B and incorporated herein by reference.

Parcel 2
A strip of land sixty (60) feet in width, being part of the S1/2SW1/4 of Section 23,
T31N, R119W, Lincoln County, Wyoming, with the centerline being more
particularly described on the attached Exhibit D, "Description for James Ivan
Ridge Trust, a Revocable Living Trust, U /A/D Dated 21 December 1999 Big
Ridge Road Tract which is incorporated herein by this reference.

A strip of land 33.00 feet in width, being more particularly described in the
attached Exhibit E, "Description for William R. Peck, et al. Access Easement
Revised (2) which is incorporated herein by this reference.

Beginning at the end of the above described portion of the easement (Parcel 3) on
the south line of the N1/2NW1/4 of Section 27 and continuing 16 1/2 feet on either
side of the center line of the existing road in a generally southerly direction through
the west side of Section 27 and through the east side of Section 28 to the point of
intersection of the road and the boundary of Sections 28 and 33, said boundary also
being the north boundary of the Bridger National Forest; thence commencing again
where said road intersects the east boundary of the Bridger National Forest on the
common boundary of Sections 33 and 34 and continues generally in a southerly
direction through the west side of Section 34 to the south boundary of Section 34
