LOAN MODIFICATION AGREEMENT RECEIVED 3/31/2010 at 2:21 PM RECEIVING 952741 BOOK: 744 PAGE: 763 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY 000'763 This agreement is made and entered into between First International Bank Trust, the "Bank and William J. Wiemann, a single person, the "Mortgagor(s)" The Bank is the holder of a note #165036, mortgage and assignment of leases and rents, incorporated in this agreement by reference, executed on August 28, 2007, as evidence of and security for a loan made to the Borrower by the First International Bank Trust on August 28, 2007. The Borrower is now indebted to the Bank in the sum of $3,668,813.87. $3,631,530.17 consisting of principal and $37,283.70 consisting of interest and as of this date and no unpaid installments of ground rents, hazard insurance premiums, taxes, assessments, and mortgage insurance premiums, the payment of which is secured by a Note, Mortgage, and Assignment of Leases and Rents owned and held by the Bank dated August 28, 2007 and recorded in the office of Lincoln County Clerk, Kemmerer, Wyoming on September 17, 2007 as Receiving #933152, Book 672 and Page 314. The Mortgage and Assignment of Leases and Rents covers the following described real property: Lot Forty Two (42) of Alpine Village Subdivision No 1, Plat 2, Amended, Lincoln County, Wyoming as described on the Official Plat thereof Recorded June 4, 1981 at Document Number 559191, and Map Number 264 in the Office of the Clerk, Lincoln County, Wyoming The parties mutually desire and agree to modify the following terms and conditions and will become effective on the date this document is executed by all partners: The monthly principal and interest payments from March 5, 2010 thru June 5, 2010 will b deferred to the July 5, 2010 payment and at that time only accrued interest from March 5 to July 5 is due and payable. The regular monthly principal and interest payments will resume on the 5 tIi of Augu t 2010 until the maturity date of September 5, 2012. The new amortization schedule will be 25 m nthly principal and interest payments of $28,526.30 starting with the August 5, 2010 and a ba loon payment of the remaining interest, principal and any fee charges will be due on September 5, 012. All other terms and conditions will remain the same. The Mortgage shall continue as a second lien upon the premises and neither the obligation evidencing this indebtedness nor the mortgage securing the same shall in any way be prejudiced by this Agreement, but the obligation and Mortgage and Assignment of Lease and Rents and all ovenants and agreements the of and the rights of the parties thereunder shall remain in full force an feet except as herein expre ly modified.
