WARRANTY DEED IN LIEU OF FORECLOSURE
FOR VALUE RECEIVED, Kay M. Burton and Aneta R. Burton, husband and wife,
the Grantors, do hereby grant, bargain, sell and convey unto Hilda A. Titensor, trustee of
the Von S. Titensor Revocable Trust, dated the 12th day of November, 1986, the following
described premises, in Lincoln County, Wyoming, hereby releasing and waiving all rights
under and by virtue of the homestead exemption laws of the State,
TO WIT:
Lot 3 contained within the "BURTON TWINHOME ADDITION TO THE
TOWN OF AFTON IN THE N1/2 LOT 1 BLOCK 5 ORIGINAL TOWNSITE
OF AFTON WITHIN THE SW1 /4NW1/4 SECTION 30 T32N Rii8W
LINCOLN COUNTY, WYOMING" as recorded in the official records in the
Lincoln County Clerk in and for the County of Lincoln, State of Wyoming
with Instrument No. 945874.
TO HAVE AND TO HOLD the said premises, with their appurtenances unto the
said Grantee, heirs and assigns forever. And the said Grantors do hereby covenant to
and with the said Grantees they are the owners in fee simple of said premises; that they
are free from all encumbrances EXCEPT: Subject to all existing patent reservations,
easements, rights of way, protective covenants, zoning ordinances, and applicable
building codes, laws and regulations, general taxes, assessments, including irrigation
and utility easements (if any) for the current year, which are not due and payable, and
that Grantors will warrant and defend the same from all lawful claims whatsoever.
The deed was an absolute conveyance of the title to the property to the Grantee
named therein in effect as well as in form, and was not intended as a mortgage, trust
conveyance, or security agreement of any kind, and possession of the premises has been
surrendered to Grantee.
The Deed and conveyance were made by Affiant as a result of his request that
Grantee accept the deed and was his free and voluntary act.
The deed was not given as a preference against any other creditors of Affiant.
In executing and delivering the deed to Grantee, Affiant was not subject to or
under any duress, undue influence, misapprehension, or misrepresentation by Grantee
in the deed, or the agent or attorney or any other representative of Grantee in the deed,
and was afforded the opportunity to consult with an attorney of his own choosing.
It is the purpose and intent of Grantor and Grantee that the interests of Grantee
shall not merge with the interest of The Bank of Star Valley under the Deed in Lieu of
Foreclosure Agreement.
