HomeMy WebLinkAbout952841PROMISSORY NOTE The undersigned, jointly and severally promise to pay to the order of Felicia Oldfather, at 2679 Sunnygrove Ave., McKinleyville CA, 95519, or at such other place as holder hereof may designate in writing, the sum of Two Hundred Fifty Thousand dollars and zero cents ($250,000.00), lawful money of the United States, payable as follows: Payments of $1498.88 per month due on the 15 day of each month beginning April 15, 2010 with the final payment due April 15, 2040. Interest on the unpaid balance thereof from date until paid at the rate of Six percent (6 per annum. A late charge of 5% of the payment due will be charged if the payment is received more than 15 days past the due date. Prepayment of the note with interest to date may be made at any time without penalty. Mortgage is secured by the property described below: 714 Sunset Ave, Alpine Wyoming. Lot 244 of Lakeview Estates, Tract A, a subdivision of the S %Z SE of Section 29, Township 37 North Range 118, 6 P.M, Wyoming according to the plat recorded in the Office of the Lincoln County clerk. If the holder deems itself insecure or if default be made in payment of the whole or any part of any installment at the time when and the place where to same becomes due and payable as aforesaid, then the entire unpaid balance, with interest as aforesaid, shall at the election of the holder, hereof, and without notices of said election at once become due and payable. In the event of any such default or acceleration, the undersigned, jointly and severally, agree to pay to the holder, hereof, reasonable attorney's fees, legal expenses and lawful collection of costs in addition to all other sums due hereunder. The makers, sureties, guarantors and endorsers hereof severally waive presentment for payment, demand and notice of dishonor and nonpayment of this note, and consent to any and all extensions of time, renewals, waivers or modifications that may be granted by the holder hereof with respect to payment or other provisions of this note, and to the release of any security, or any part thereof, with or without substitution.
