AND RESTRICTIONS
TRIANGLE II SUBDIVISION
This Declaration is made as of January 27, 2010 by Keith Harris, owner of the
property described as the Triangle II Subdivision located within the T25N, R119W,
Section 27, Pt. Tract 45.
At this time, Keith Harris declares that all lots held, sold and conveyed within the
Triangle II Subdivision are subject to the following restrictions. The purpose of
these restrictions is to protect the value and desirability of said lots, avoid future
legal conflicts over land and water use, and to insure the delivery of water shares.
Article 1
USE AND RESTRICTIVE COVENANTS
Sectionl. Land Classification. All land within Triangle II Subdivision will remain as
single family residence and for agricultural use.
Section 2. General Restrictions. The following general restrictions shall apply to all
lots.
(a) Each lot or tract shall be used exclusively for single- family residential and /or
agricultural purposes.
(b) The owner shall maintain each lot, and all improvements, in good condition
and repair, and in such manner as not to create a fire hazard or detract from
the value of neighboring properties.
(c) The population of domestic livestock residing on any lot within the Triangle
II Subdivision shall be limited to two large animals per grazeable acre owned
and one small animal per acre owned. Grazeable acre is defined as land that
is readily available for grazing, and is not used for access roads, buildings, or
gardens landscaping. Lot owners are responsible to ensure that their
grazeable acres are managed in such a way to avoid over grazing and
destruction of pasture grasses.
(d) Lot owners within the Triangle II Subdivision are responsible for ensuring
that their lot remains free of junk and clutter (i.e. cars, trailers, equipment,
etc.) that would serve to detract from the value of neighboring lots.
Article 2
STANDARDS AND RESTRICTIONS APPLICABLE TO CONSRUCTION

(a) Houses on all lots within the Triangle II Subdivision will be built on
permanent foundations, and be of framed or log construction. No single
or doublewide trailers, or mobile or manufactured homes will be allowed.
(b) All out buildings within the Triangle II Subdivision will be constructed in
such a manner, and with materials that do not detract from the value of
neighboring lots.
Article 3
MISCELLANEOUS PROVISIONS
Section 1. Water from Whites Water Ditch:
(a) All lot owners in the Triangle II Subdivision are to strictly abide
the requirements set forth in the Water Distribution Plan
approved by the State of Wyoming Board of Control.
(b) No lot owner in the Triangle II Subdivision may bring suit against
any other lot owner or Lincoln County because they disagree with
the Water Distribution Plan approved by the State of Wyoming
Board of Control.
(c) No lot owner in the Triangle II Subdivision will put in place any
obstruction in the existing ditch, impede, alter, or reroute the
existing course of water, or engage in any practice that will
prevent others from receiving their appropriated water shares. In
the event that such a practice should take place, the individual
responsible for said practice will be financially liable for the cost of
returning the water infrastructure to the current state.
(d) All lot owners in the Triangle II Subdivision will share in the
responsibility of maintaining the existing ditch to ensure that
water flow is not obstructed.
Section 2. Water Wells:
(a) No water wells will be allowed except for the use of providing culinary
water for a single family residence.
(b) In the event that a new well has an adverse effect on existing wells, the
owner of the new well will be financially responsible for rectifying the
situation to the current status and ground water flow.
Section 3. Weed Control:
(a) All lot owners will be responsible for the maintenance and control of
noxious weeds on lands that they own.
