WHEREAS, Craig L. Jordan, as mortgagor(s), mortgaged to
Mortgage Electronic Registration Systems, Inc., as nominee for America's
Wholesale Lender, as mortgagee, the hereinafter described real property by that
certain mortgage dated May 7, 2004 (the "Mortgage and duly recorded in the
records of the office of the County Clerk and ex- officio Register of Deeds in and
for Lincoln County, State of Wyoming, on May 13, 2004, at Reception No.
899262 in Book 555 at Page 235.
The mortgage and note secured thereby were assigned for value as follows:
Assignee: Bank of New York as Trustee for the Certificateholders of CWMBS
2004 -12
Assignment dated: April 16, 2007
Assignment recorded: April 20, 2007
Assignment recording information: at Reception No. 928608 in Book 655 at Page
All in the records of the County Clerk and ex- officio Register of Deeds in and for
Lincoln County, Wyoming; and
WHEREAS, the Mortgage being in default, the undersigned Sheriff
in and for Lincoln County, State of Wyoming, pursuant to the request and
direction of Bank of New York as Trustee for the Certificateholders of CWMBS
2004 -12, acting under a power of sale contained in the Mortgage, proceeded to
advertise for sale and did sell the hereinafter described real property on
December 15, 2009, at 10:00 o'clock in the forenoon, at public vendue, at the
front door of the Lincoln County Courthouse located at 925 Sage Avenue,
Kemmerer, WY, Lincoln County, State of Wyoming; and
WHEREAS, Bank of New York as Trustee for the Certificateholders
of CWMBS 2004 -12 "Successful Bidder made the highest and best bid for the
hereinafter described real property in the sum of $182,675.77, and the said real
property was then and there sold to the Successful Bidder on December 15,
2009 "Sale Date and a Certificate of Sale was issued by the undersigned
Sheriff in and for Lincoln County, State of Wyoming, to the Successful Bidder, on
the Sale Date, which Certificate of Sale was duly recorded in the records of the
office of the County Clerk and ex- officio Register of Deeds in and for Lincoln
County, State of Wyoming, on December 15, 2009, at Reception No. 951088 in
Book 738 at Page 267;
WHEREAS, no one has appeared to redeem the hereinafter
described real property under the laws of the State of Wyoming, and the time for
doing so has now expired;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS,
that I, Shane Johnson, Sheriff in and for said County of Lincoln, State of
Wyoming, in consideration of the premises, have GRANTED, BARGAINED, and
SOLD, and do hereby TRANSFER and CONVEY, to said Bank of New York as
Trustee for the Certificateholders of CWMBS 2004 -12, 400 Countrywide Way,
SV 35, P.O. Box 10232, Simi Valley, CA 93065 -6298, its successors and
assigns, all right, title, and interest to the following described real property situate
in Lincoln County, State of Wyoming, to -wit:
