That for and in consideration of the sum of Ten Dollars ($10.00) and other valuable considerations, the receipt of which is hereby
acknowledged and confessed, Pittsburg and Midway Coal Mining Company of the County of Lincoln and State of Wyoming,
hereinafter called the grantor, hereby grants to THE TRANSPORTATION COMMISSION OF WYOMING, 5300 Bishop Blvd.,
Cheyenne, WY 82009-3340, its assigns or successors herein called the grantee, the right to lay out, construct, inspect, operate and
maintain a road for the use of the public over and across the following described lands located in the County of Lincoln and State of
Wyoming, to-wit: Portions of Tracts 62,71,72,73 and 74, Sections 1 and 12, Resurvey T. 21 N., R. 116 W.; Lot 49, Section 36 and Lot
2 and NW'/4SE'/<, Section 25, Resurvey T. 22 N., R. 116 W., all of the 6`h P.M., Wyoming.
The right-of-way hereby granted being more particularly described as follows:
PARCEL N0.2: A parcel of land located in Tracts 62 and 71, Section 12, Resurvey T.21 N., R. 116W. of
the 6`t' P.M., Wyoming, lying between the presently existing westerly right-of-way boundary of State
Highway
No. 189 and a parallel right-of-way line 33.5 meters (109.91 feet) to the left or westerly side when measured at right angles
or radially to the following described survey line of highway, said parallel right-of-way line begins in Tract 71 and ends at
the intersection of the southerly boundary of a certain tract of land described in Book 237PR at Page 263:
Commencing at a point on the north boundary of said Tract 62 from which corner 4 of said tract bears
N.89045'21.8"W. a distance of 51.493 meters (168.94 feet) (said corner being monumented by an aluminum survey cap, LS-
482, 1999) and corner 1 thereof bears S.89°45'21.8"E. a distance of 351.323 meters (1,152.63 feet) (said corner being
monumented by a GLO brass cap, 1908);
thence S.5°47'04.8"E. a distance of 424.144 meters (1,391.55 feet);
thence S.28°52'47.1 "W. a distance of 237.454 meters (779.05 feet) to the point of beginning of a spiraled curve
concave westerly, the spiral lengths of which are 100 meters (328.08 feet), the total length of which is 463.005 meters
(1,519.05 feet) and the total central angle of which is 34°39'51.9" and at which point a line tangent to said curve bears
N.28052'47.1"E., said point also being on the survey line of said highway 189;
thence northerly along said spiral are, through a central angle of 4°46'28.7" a distance of 100 meters (328.08 feet)
to the point of beginning of the circular arc of said curve, also being the True Point of Beginning;
thence with a parallel right-of-way line 33.5 meters (109.91 feet) to the left or westerly side as the westerly boundary
of this parcel and the presently existing westerly right-of-way boundary as the right or easterly boundary of this parcel,
continuing northerly along said curve through a central angle of 25°06'54.4" a distance of 263.005 meters (862.88 feet) to
the point of beginning of a spiral arc of said curve;
thence continuing with last described left and right boundaries, northerly along said spiral arc, through a central angle
of 4°46'28.7" a distance of 100 meters (328.08 feet) to the point of ending of said spiraled curve;
thence continuing with last described left and right boundaries, N.5°47'04.8"W. a distance of 21 meters (69 feet),
more or less, until said parallel right-of-way line intersects the southerly boundary of a certain tract of land described in Book
237PR at Page 263.
Basis of bearing for the above described parcel of land is N.89°45'21.8"W. between corners 1 and 4 of Tract 62.
The above described parcel of land contains 0.492 of a hectare (1.21 acres), more or less.
PARCEL NO. 2A: A parcel of land located in Tracts 72 and 74, Section 12, Resurvey T. 21 N., R. 116 W.
of the 6`'' P.M., Wyoming, lying between the presently existing easterly right-of-way boundary of State
Highway No. 189 and a parallel right-of-way line of hereinafter stated distances to the right or easterly side when measured
at right angles or radially to the following described survey line of highway, said parallel right-of-way line begins in Tract
72 and ends in Tract 74:
Commencing at a point on the south boundary of said Tract 74 from which corner 3 of said tract bears
N.89°45'11.3"W. a distance of 591.034 meters (1,939.09 feet) (said corner being monumented by an aluminum survey cap,
LS-482, 1998) and corner 2 thereof bears S.89'45'1 1.3"E. a distance of 213.438 meters (700.26 feet) (said corner being
monumented by an aluminum survey cap, LS-482,1998), said point also being on a circular curve concave easterly, the radius
of which is 800 meters (2,624.67 feet) and a line tangent to said curve bears N.33°1 1'47.4"E., said point also being on the
survey line of said highway 189;
thence northerly along said curve through a central angle of 0°27'44.8" a distance of 6.457 meters (21.18 feet) to the

the presently existing easterly right-of-way boundary of State Highway No. 189.

The above described parcel of land contains 0.278 of a hectare (0.69 of an acre), more or less.
PARCEL NO. 2B: A parcel of land located in Tracts 73 and 74, Sections 1 and 12, Resurvey T. 21 N., R.
116 W. of the 6`h P.M., Wyoming, lying between the presently existing westerly right-of-way boundary of

Highway No. 189 and a parallel right-of-way line 33.5 meters (109.91 feet) to the left or westerly side when measured
radially to the following described survey line of highway, said parallel right-of-way line begins in Tract 74 and ends in Tract

Commencing at a point on the south boundary of said Tract 74 from which corner 3 of said tract bears

meters (722 feet), more or less, until said parallel right-of-way line intersects the southerly boundary of a certain tract of land

Commencing at a point on the east boundary of Lot 13, Section 1, Resurvey T. 21 N., R. 116 W. from which the
northeast corner of said Lot 13 bears N.0°45'01.8"E. a distance of 156.326 meters (512.88 feet) (said corner being
monumented by an aluminum survey cap, LS-482, 1999) and the southeast corner thereof bears S.0'45'0 1.8"W. a distance
of 194.708 meters (638.81 feet) (said corner being monumented by a GLO brass cap, 1908);

PARCEL NO. 2E: A parcel of land located in Lot 49, Section 36, Resurvey T. 22 N., R. 116 W. of the 6t'
P.M., Wyoming, lying between the presently existing easterly right-of-way boundary of State Highway No.
189 and a parallel right-of-way line 36.5 meters (119.75 feet) to the right or easterly side when measured radially to the
following described survey line of highway, said parallel right-of-way line begins on the south boundary and ends in said
Lot 49:
Beginning at a point on said survey line of highway from which the south 1/4-comer of said Section 36 bears
N.89054'1 1.6"E. a distance of 76.430 meters (250.75 feet) (said corner being monumented by a brass survey cap, LS-
164,1981) and the west 1/16 corner of Section 1-36, Resurvey T. 21-22 N., R. 116 W. bears 5.89°54'11.6"W. a distance of
296.502 meters (972.'78 feet) (said corner being monumented by a brass survey cap, LS-164, 1980), said point also being on
the circular arc of a spiraled curve concave easterly, the spiral lengths of which are 100 meters (328.08 feet), the total length
of which is 538.022 meters (1,765.16 feet) and the total central angle of which is 45°37'50.0" and a line tangent to said curve
bears N.5°34'03.3"E.;
thence with said parallel right-of-way line 36.5 meters (119.75 feet) to the right or easterly side being the right or

Basis of bearing for the above described parcel of land is S.89°52'02.6"E. between the north quarter corner and the
northeast corner of said Section 36.
The above described parcel of land contains 1.074 hectares (2.65 acres), more or less.
Grantor also grants the right of ingress and egress to and from the said land for any and all purposes necessary and incident to
the exercise by the grantee, and the public, of the rights granted by this conveyance.
Grantee agrees to construct culverts of suitable size across such ditches and laterals of grantor as necessary for proper operation
of his irrigation system.
Grantors hereto do hereby waive and release all rights under and by virtue of the homestead exemption laws of the State of
Wyoming insofar as affected by this conveyance.
Grantor will not use, or permit to be used, the conveyed property for any purpose whatsoever; that exclusive use is hereby granted
to the grantee.
The grant herein contained is an easement and shall be perpetual so long as the main traveled portion of said land is used for the
aforementioned purposes, and whether or not actually fenced or used in its entirety for the aforementioned purposes.
