That for and in consideration of the sum of Ten Dollars ($10.00) and other valuable considerations, the re`at tLh i'}~ G
acknowledged and confessed, Pittsburg and Midway Coal Mining Company, of the County of Lincoln and State of Wyoming,
hereinafter called the grantor, hereby grants to THE LINCOLN COUNTY COMMISSIONERS, LINCOLN COUNTY, WYOMING,
whose address is 925 Sage Avenue, Kemmerer, WY 83101, its assigns or successors herein called the grantee, the right to lay out,
construct, inspect, operate and maintain a road for the use of the public over and across the following described lands located in the County
of Lincoln and State of Wyoming, to-wit: Portion of Lot 49, Section 36, Resurvey T. 22 N., R. 116 W. of the 6`h P.M., Wyoming,
The right-of-way hereby granted being more particularly described as follows:
A parcel of land located in Lot 49, Section 36, Resurvey T, 22 N., R. 116W. of the 6' P.M., Wyoming, lying
between parallel right-of-way lines 18.288 meters (60.00 feet) apart, being 9.144 meters (30.00 feet) on each
side when measured at right angles or radially to the following described survey line of Fox Farm County Road No. 12-327,
said parallel right-of-way lines begin on the presently existing-northwesterly right-of-way boundary of State Highway No.
189 and end on the presently existing right-of-way boundary of said county road:
Commencing at a point on said survey line of highway from which the south 1/4 corner of said Section 36 bears
N.89054'1 1.6"E. a distance of 76.430 meters (250.75 feet) (said corner being monumented by a brass survey cap, LS-
164,1981) and the west 1/16 corner of Section 1-36, Resurvey T. 21-22 N., R. 116 W. bears S.89'54'1 1.6"W'. a distance of
296.502 meters (972.78 feet) (said corner being monumented by a brass survey cap, LS-164, 1980), said point also being on
the circular arc of a spiraled curve concave easterly, the spiral lengths of which are 100 meters (328.08 feet), the total length
of which is 538.022 meters (1,765.16 feet) and the total central angle of which is 45°37'50.0" and a line tangent to said curve
bears N.5°34'03.3"E.;
thence northerly along the circular arc of said curve through a central angle of 19°17'51.1" a distance of 185.243
meters (607.75 feet), to the point of beginning of the spiral arc of said curve;
thence northerly along the spiral arc of said curve through a central angle of 5°12'31.3" a distance of 100 meters
(328.08 feet) to the point of ending of said curve;
thence N.30°04'25.7"E. a distance of 43.125 meters (141.49 feet);
thence N.60036'48.5"W. a distance of 24.934 meters (81.80 feet);
thence S.34°32'19.5"W. a distance of 47.391 meters (155;48 feet) to a point where the presently existing
northwesterly right-of-way boundary of State Highway No. 189 intersects a parallel right-of-way line 9.144 meters (30.00
feet) to the right or northwesterly side when measured at right angles to said survey line, also being the True Point of
Beginning;
thence with said parallel right-of-way line 9.144 meters (30.00 feet) to the right or northwesterly side being the right
or northwesterly boundary of this parcel and the presently existing left or northwesterly right-of-way boundary and proposed
right-of-way line being the left or southeasterly boundary of this parcel, continuing S.34°32'19.5"W. a distance of 73.176
meters (240.08 feet) to the point of beginning of a spiraled curve concave northwesterly, the spiral lengths of which are 50
meters (164.04 feet), the total length of which is 158.203 meters (519."04 feet) and the total central angle of which is
61 °59'44.2'';
thence southwesterly along said spiral arc, through central angle of 4°49'06.9" a distance of 29 meters (95.14 feet),
to a point where the presently existing northwesterly right-of-way boundary of State Highway No. 189 intersects a parallel
right-of-way line 9.144 meters (30.00 feet) to the left or southeasterly side when measured radially to said survey line;
thence with parallel right-of-way lines 18.288 meters (60.00 feet) apart, being 9.144 meters (30.00 feet) on each side
continuing southwesterly along said spiral are, through a central angle of 9°30'19.3" a distance of 21 meters (68.90 feet) to
the point of beginning of the circular arc of said curve;
thence continuing with last described left and right boundaries, southwesterly along the circular arc of said curve
through a central angle of 33°20'51.8" a distance of 58.203 meters (190.95 feet) to the point of beginning of a spiral arc of
said curve;
thence continuing with last described left and right boundaries, southwesterly along the spiral arc of said curve
through a central angle of 14°19'26.2" a distance of 50 meters (164.04 feet) to the point of ending of said spiraled curve;
thence continuing with last described left and right boundaries, N.83°27'56.4"W. a distance of 12.576 meters (41.26
feet) to the point of beginning of a spiraled curve concave southerly, the spiral lengths of which are 50 meters (164.04 feet),
the total length of which is .125.942 meters (413.20 feet) and the total central angle of which is 43°30'41.8";
thence continuing with last described left and right boundaries, westerly along said curve through a central angle of
43°30'41.8" a distance of 125.942 meters (413.20 feet) to the point of ending of said spiraled curve, and the point of ending.
LESS and EXCEPTING therefrom any portion of land between the presently existing and proposed northwesterly
right-of-way lines of State Highway No. 189 and the presently existing right-of-way of Fox Farm County Road No. 12-327.
Basis of bearing for the above described parcel of land is S.89'54'1 1.6"W. between the south 1/4 corner of Section
36 and the west 1/16 corner of Section 1-36, Resurvey T. 21-22 N., R. 116 W.
The parcel of land hereby conveyed contains 0.348 of a hectare (0.86 of an acre), more or less.

Grantor also grants the right of ingress and egress to and from the said land for any and all purposes necessary and incident to
the exercise by the grantee, and the public, of the rights granted by this conveyance.
Grantee agrees to construct culverts of suitable size across such ditches and laterals of grantor as necessary for proper operation
of his irrigation system.
Grantors hereto do hereby waive and release all rights under and by virtue of the homestead exemption laws of the State of
Wyoming insofar as affected by this conveyance.
Grantor will not use, or permit to be used, the conveyed property for any purpose whatsoever; that exclusive use is hereby granted
to the grantee.
The grant herein contained is an easement and shall be perpetual so long as the main traveled portion of said land is used for the
aforementioned purposes, and whether or not actually fenced or used in its entirety for the aforementioned purposes.
