JUDGMENT AND DECREE OF DIVORCE
THE ABOVE ENTITLED MATTER came before the Court on the Stipulation of the parties
which is on file herein. Plaintiff being represented by and through her attorney, Tammy A. Burt.
Plaintiff's Affidavit is on file herein. Defendant being represented by and through his attorney, John
A. Thomas. The Court has reviewed the evidence and examined the file herein and finds generally
for the Plaintiff on her Complaint. The Court further finds that the Plaintiff has resided in Lincoln
County, Wyoming for more than 60 days preceding the date her Complaint was filed; that the
parties were married July 16, 1969 in Carson City, Nevada and are still husband and wife; that
irreconcilable differences exist in the marriage; and that the parties have entered into a Stipulation
concerning the division of property and debts, the terms of which should be incorporated herein.
IT IS THEREFORE HEREBY ORDERED, ADJUDGED AND DECREED:
1. That Plaintiff is awarded an absolute divorce from the Defendant.
2. Each party shall pay their own attorneys fees in this action.
3. Plaintiff, Linda Gardner, shall have as her sole and separate property the following,
subject to any and all indebtedness:
a. Defendant shall pay to Plaintiff the sum of $120,000 for her one half of the
net equity in the marital residence located at 150 Swift Creek Lane, Afton,
Wyoming and vehicles which are awarded to Defendant

b. One -half of Defendant's Wyoming State Law Enforcement Retirement as of
November 12, 2009 which is approximately $1,200 per month
c. One -half of Defendant's deferred compensation account with Waddell and
Reed as November 12, 2009
d. One -half of the $70,000 purchase price of the Mexico house (which has
already been paid by Defendant to Plaintiff)
e. $1,000.00 of the Wells Fargo marital checking account number

f. One -half the balance of the Wells Fargo marital savings account number
XXXXXX5310 as of November 12, 2009
g. One -half the balance of the Bank of Star Valley marital savings account
number XXXX3610 as of November 12, 2009 in the amount $6,970.00
h. One -half of the remaining proceeds from the sale of the mobile home to
Mark Barrus of approximately $4,600 as of November 12, 2009

4. Defendant, Lee Gardner, shall have as his sole and separate property the following,
subject to any and all indebtedness:
a. All real estate, personal property, financial accounts, gifts and any and all
other assets and expectancies from Defendant's grandparents, parents and
their estates
b. Marital residence located at 150 Swift Creek Lane, Afton, Wyoming
c. One -half of Defendant's deferred compensation account with Waddell and
Reed as of November 12, 2009
d. Mexico house
e. Wells Fargo marital checking account number XXXXXX7103
f. One -half the balance of the Wells Fargo marital savings account number
XXXXXX5310 as of November 12, 2009
g. One -half the balance of the Bank of Star Valley marital savings account
number XXXX3610 as of November 12, 2009 in the amount of $6,970.00
h. One -half of the remaining proceeds from the sale of the mobile home to
Mark Barrus of approximately $4,600.00 as of November 12, 2009

5. Each party shall be responsible for the debts incurred by him or her since the date
of their separation on November 6, 2008.
6. In the event any subsequent action should be commenced by either party against
the other involving any of the provisions which are the subject matter of this proceeding and any
future orders and decrees filed herein, then the losing party to such action as evidenced by an order
or judgment against the person shall pay all the successful party's attorney's fees and costs in such
action, unless otherwise ordered by the court.
7. The parties hereto shall execute and deliver such instruments as the other of them
may reasonably require to fully effectuate the provisions of this Judgment and Decree of Divorce.
8. The Stipulation entered into by and between the parties hereto and filed herein is
hereby approved, ratified and affirmed and is hereby made a part of this Decree as fully and to the
same extent as if the terms thereof were set forth herein in full.

9. Neither party will charge any items of merchandise or otherwise pledge the credit
of the other party for anything and each indemnifies the other for the same.
