Michael Ray Sanchez, Trustee of the Michael Ray Sanchez Revocable Trust dated
November 23, 2004, of PO Box 1089 Afton, WY 83110, (herein collectively called
`MORTGAGOR to secure the payment of $79,000.00, with interest thereon, as provided in
and evidenced by a promissory note of even date herewith (the ultimate maturity date of which is
June 30, 2015) and all renewals, modification and extensions thereof, do hereby mortgage unto
Wayne Hesson of PO Box 460 Thayne, WY 83127 (herein called "MORTGAGEE the
following described real property, situate in the County of Lincoln, State of WY, hereby
releasing and waiving all rights under and by virtue of the homestead exemption laws of the
State of Wyoming, to -wit:
A portion of the property, as referred to in the Deed recorded, with Document No. 868366, in
Book 452PR on Page 94, and a portion of the property, as referred to in the Deed recorded,
with Document No. 859985 in Book 433PR on Page 29 with the Office of the Clerk of Lincoln
County, Wyoming, within the South Half of Section 4, Township 31 North, Range 119 West of
the 6 P.M., Lincoln County, Wyoming, the metes and bound being more particularly
described as follows:
BEGINNING at the Lloyd B. Baker PE /LS 698 1986 location for the Northeast Corner of the
Southeast Quarter of the Southwest Quarter of said Section 4;
thence South 89 °00'23" West, along the North line of said Southeast Quarter of the
Southwest Quarter, 564.60 feet;
thence North 28 °30'44" East, 823.78 feet;
thence North 7 °29'29" West, 184.50 feet to a point in the South line of the Mignano property as
referred to in the Deed recorded with Receiving No. 904781, in Book 573 on Page 345, with
said Office;
thence South 77 °48'39" East, along the South line of said Mignano property, 357.57 feet;
thence South 89 °14'35" East, continuing along said South line, 30.00 feet, to the Northeast
corner of the Roberts Property, as referred to in the Deed recorded with Document No.
870697, in Book 458PR on page 97, with said Office;
thence Southerly and Easterly along the West and South line of said Roberts property the
following:
South 7 °29'29" East, 421.10 feet;
South 54 °37'06" East, 135.58 feet;
and, North 68 °12'46" East, 188.72 feet to the Southwest of the Smith property, as
referred to in the Deed recorded with Document No. 878472, in Book 481 PR on page
87, with said Office;
thence South 75 °56'42" East, along the South line of said Smith property, 131.87 feet to a point
in the Centerline of Crow Creek County Road No. 12 -141 Right -of -Way as referred to in
the Right -of -Way Easement as recorded with Document No. 551386, in Boon 171PR on
page 750, with said Office;
thence Southerly along said Center the following:
South 14 °38'16" West, 130.68 feet to the Beginning of an 881.22 feet Radius Curve to the
Left, Southwesterly, along said Curve to the Left, through a Central Angle of 22 °51'51 an
arc length of 351.66 feet, said Curve having a chord of South 3 °12'21" West, 349.33 feet;
South 8 °13'35" East, 118.88 to the beginning of a 1,210.25 feet Radius Curve to the Right,
and Southeasterly along said Curve to the Right through a Central Angle of 2 °54'21 an
arc length of 61.38 feet, said curve having a chord of South 6 °34'45" East, 61.37 feet from
which the radius point bears South 84 °40'47" West;
thence North 90 °00'00" West, 632.12 feet to a point in the East line of said Southeast Quarter
of the Southwest Quarter;
thence North 1 °33'04" East, along said East line, 290.82 feet, to the POINT OF BEGINNING.
MORTGAGOR agrees to pay the indebtedness hereby secured; to pay all taxes, assessments and
charges levied against the property, as the same become due and payable; to secure, maintain and
furnish MORTGAGEE evidence thereof, insurance with an insurance carrier or carriers
acceptable to MORTGAGEE, covering the insurance improvements on the Property against loss
by fire and earthquakes, with extended coverage, in an amount not less than the unpaid balance
of the debt hereby secured, or the insurable value (replacement cost) of such improvements,
whichever is less, which insurance shall contain an appropriate loss payable provision protecting
MORTGAGOR and MORTGAGEE as their respective interests may appear from time to time.
In the event MORTGAGOR fails to pay such taxes or assessments, or fails to keep and maintain
such insurance as herein provided, MORTGAGEE may pay such taxes and assessments and may
secure and pay for such insurance, and all sums so paid shall be added to and considered a part of
the indebtedness hereby secured and shall draw interest at the same rate.
In case default shall be made in the payment of the above sums hereby secured, or in the
payment of the interest thereon, or any part of such principal or interest, when the same shall
become due; or in case of default shall be made in any of the covenants and agreements thereof,
or in the event MORTGAGOR sells or conveys the Property, or any part thereof, or any interest
therein, without the prior written consent of the MORTGAGEE first had and obtained, then the
whole indebtedness hereby secured, with interest thereon, shall become due and payable, at the
option of MORTGAGEE, and MORTGAGEE'S legal representatives and assigns, may proceed
by advertisement and sale /or as otherwise authorized by governing law, to foreclose on and sell
the Property, and out of the proceeds of such sale, MORTGAGEE shall pay all sums due
hereunder, together with all costs of sale including reasonable attorney's fees. If the proceeds of
the foreclosure sale are insufficient to pay the indebtedness hereby secured and foreclosure costs,
MORTGAGEE shall be entitled to a deficiency judgment.
In the event of any default whereby the right of foreclosure occurs hereunder, MORTGAGEE
shall at once become entitled to exclusive possession, use and enjoyment of the Property, and to
all rents, issues and profits from the accruing of any such rights and during the pendency of the
foreclosure proceedings, and the period of redemption, if any there be.
MORTGAGOR warrants title to the Property as to parties claiming, by, through or under the
MORTGAGOR only.
