WY AFFIDAVIT OF VACATION OF PLAT NO. 202-A AND PARTIAL VACATION OF PLAT NO. 13 -F C COME NOW RIVER BEND MEADOWS, LLC, a Wyoming limited liability company, as to Lots 1, 2, 3, 4, 5, 6, 10, 11, 16, 17, 18, 19, 20, 21, 22, 26, 27, 28, 29, 30, 32, 33, and 35; ANDREW P. HANSON and KATHERINE A. HANSON, TRUSTEES of the Hanson Family Living Trust dated April 15, 2003, as to Lots 7 and 23; RONDELL B. HANSON and JOYCE P. HANSON, TRUSTEES of the Hanson Family Revocable Trust established June 6, 1991, as to Lots 8 and 34; JAMES M. KRUEGER and CAROL F. KRUEGER, TRUSTEES of the Krueger Family Trust dated June 27, 1989, as to Lots 25 and 31; TEMPEST ENTERPRISES, INC., a Utah corporation registered to do business in Wyoming, as to Lots 9 and 24, hereafter, jointly, the "Parties all lots being within River Bend Meadows Subdivision, Lincoln County, Wyoming, as shown on the official plat thereof filed November 29, 2006 as Receiving No. 924843, in the Office of the Clerk of Lincoln County, Wyoming as Plat No. 217 A, and all Parties c/o 190 Newport Center Drive #100, Newport Beach, California 92660, hereby requesting vacation of Plat No. 202 -A and partial vacation of Plat No. 13 -F in accordance with Wyoming Statutes 34 -12 -106. In support thereof, the above parties state as follows: 1. That Parties are the owners of all of the lots within River Bend Meadows Subdivision that were included within the land area shown on Plats No. 202 -A and 13 -F, recorded in the land records of Lincoln County, Wyoming on October 23, 2000 as Receiving No. 869191 and on September 6, 2001 as Receiving No. 875721. 2. That the filing of Plat No. 217 -A, which created River Bend Meadows Subdivision and covered much of the same land area as Plats No. 202 -A and 13 -F, and partially superceded Plats 202 -A Plat 13 -F, and rendered both of said plats inoperative as to the lands now comprising River Bend Meadows Subdivision. 3. That the creation of River Bend Meadows Subdivision with the filing of Plat No. 217 -A did not have any affect on the portion of Plat 13 -F that created SV -100, LLC Adjustment and the accompanying 60 -foot easement for ingress and egress, and the partial vacation of Plat 13 -F should not have any application to those property rights. 4. That the vacation of Plat 202 -A and the partial vacation of Plat 13 -F as requested by the Parties does not abridge or destroy any rights and privileges of any other land owners. 5. That the Parties requested from the Lincoln County Board of Commissioners vacation of Plat 202 -A and partial vacation of Plat No. 13 -F as set forth above, and the Lincoln County Board of Commissioners approved said partial vacation at its regular meeting on the kd day of Jung. 2010, through Resolution No. 2010 a e dated 2010. That the Parties, with the approval of the Lincoln County Board of Commissioners approval, hereby declare Plat No. 202 -A vacated, and Plat No. 13 -F partially vacated as to the lands now comprising River Bend Meadows Subdivision, and specifically excluding from the vacation the lands comprising SV -100, LLC Adjustment and the accompanying 60 -foot easement for ingress and egress. 7. That the Parties respectfully request that the Clerk of Lincoln County, Wyoming, in accordance with Wyoming Statutes 34 -12 -110 mark Plat No. 202 -A "Vacated" and Mark Plat 13 -F "Partially Vacated" and reference on both plats the book and page within the Lincoln County land records where this Affidavit and the above referenced Resolution of the Lincoln County Board of Commissioners are recorded.
