HomeMy WebLinkAbout954500NOTICE OF CONTRACT AND OBLIGATION PLEASE TAKE NOTICE that GEM VIEW ENTERPRISES, LLC, ASPEN RIDGE RANCH, LLC, WHISPER RIDGE HOLDINGS, LLC, SPIRIT RIDGE MINERAL SPRINGS, LLC, JAMES IVAN RIDGE and the JAMES IVAN RIDGE TRUST U /A /D 12.21.99 [hereinafter collectively referred to as "Debtors have entered into and executed a COVENANT NOT TO EXECUTE AND SETTLEMENT AGREEMENT with SUZANNE GANO, which covenant and agreement provides Gano with certain rights, obligations and remedies as a contracting party and judgment creditor in regard to that real property located in Lincoln County, Wyoming described as follows: PARCEL 1 The Northeast Quarter of the Southeast Quarter (NE /4SEI /4) of Section 33, and the North -west Quarter of the Southwest Quarter (NW /4SW%) of Section 34 in Township 32 North, Range 119 West of the 6th P.M., Wyoming; n m CO Those portions of Sections 3 and 4 described as follows: BEGINNING at z o n C a point 6 -14/31 rods South and 16 rods West of the Northeast Corner of 0 D m the SE% of said Section 4, and running thence North 28- 188/279 rods; z o z o thence West 36 rods; thence North 57 -7/9 rods; thence East 107 rods; z 0 t Southwesterly 137.56 rods to the place of beginning; AND rn m SW%NW%, and a tract of land described as follows: BEGINNING at a x CA SD point 4 rods West of the Northeast Corner of Section 4, and running m z c thence West 76 rods; thence South 80 rods; thence West 80 rods; thence K X w South 60 rods; thence East 80 rods; thence South 20 rods; thence East 28 m rods; thence North 80 rods; thence East 48 rods; thence North 80 rods to mm the place of beginning; AND a tract of land described as follows: BEGINNING at the Northeast Corner of NW%NE% and running thence South 80 rods; thence West 55 rods; thence North 15 rods; thence East 36 rods, more or less, to the East edge of the roadway; thence meandering along said East edge of the roadway 66 rods, more or less, to a point 4 rods West of the place of beginning; thence East 4 rods to the place of beginning; all in Section 4, Township 31 North, Range 119 West of the 6th P.M., Wyoming; EXCEPTING THEREFROM: A tract of land described as follows: BEGINNING at a point which is 80 rods West and 20 rods North of the East Quarter Corner of said Section 4; thence running West 80 rods; thence North 60 rods; thence East 38 rods; thence South 54 rods; thence East 42 rods; thence South 6 rods to the place of beginning. The ownership and possessory interest of any of the Debtors in and to the above described real property is contingent upon said Debtors compliance and satisfaction of all of those terms, conditions and obligations as set forth in the Covenant Not to Execute and Settlement Agreement, and satisfaction of Gano's creditor's claim described therein.
