1. A right -of -way is hereby granted pursuant to Section 28 of the Mineral Leasing Act of 1920, as amended
(30 U.S.C. 185).
2. Nature of Interest:
a. By this instrument, the holder:
receives a right to construct, operate, maintain, and terminate a 6 inch natural gas pipeline to the
Opal 80 -30 well, on Federal lands described as follows:
6 Principal Meridian, Lincoln County, Wyoming
T. 22 N., R. 112 W.,
Section 30, SW%SE'
b. The right -of -way area granted herein is 50 feet wide, 1,945 feet long and contains 2.23 acres,
more or Tess.
c. This instrument shall terminate on December 31, 2039 unless, prior thereto, it is relinquished,
abandoned, terminated, or modified pursuant to the terms and conditions of this instrument or of
any applicable Federal law or regulation.
d. This instrument may be renewed. If renewed, the right -of -way shall be subject to the regulations
existing at the time of renewal and any other terms and conditions that the authorized officer
deems necessary to protect the public interest.
e. Notwithstanding the expiration of this instrument or any renewal thereof, early relinquishment,
abandonment, or termination, the provisions of this instrument, to the extent applicable, shall
continue in effect and shall be binding on the holder, its successors, or assigns, until they have
fully satisfied the obligations and /or liabilities accruing herein before or on account of the
expiration, or prior termination, of the grant.

For and in consideration of the rights granted, the holder agrees to pay the Bureau of Land
Management fair market value rental as determined by the authorized officer unless specifically
exempted from such payment by regulation. Provided, however, that the rental may be adjusted
by the authorized officer, whenever necessary, to reflect changes in the fair market rental value
as determined by the application of sound business management principles, and so far as
practicable and feasible, in accordance with comparable commercial practices.
4. Terms and Conditions:
a. This grant is issued subject to the holder's compliance with all applicable regulations contained
in Title 43 Code of Federal Regulations part 2880.
b. Upon grant termination by the authorized officer, all improvements shall be removed from the
Federal lands within 90 days, or otherwise disposed of as provided in paragraph (4)(c) or as
directed by the authorized officer.
c. The stipulations, plans, maps, or designs set forth in Exhibits A and B, dated March 2, 2010,
2004, attached hereto, are incorporated into and made a part of this grant instrument as fully
and effectively as if they were set forth herein in their entirety.
d. Failure of the holder to comply with applicable law or any provision of this right -of -way grant shall
constitute grounds for suspension or termination thereof.
e. The holder shall perform all operations in a good and workmanlike manner so as to ensure
protection of the environment and the health and safety of the public.
f. The holder shall construct, operate, and maintain the facilities, improvements, and structures
within this right -of -way in strict conformity with the plan of development which was approved and
made part of the grant on March 2, 2010. Any relocation, additional construction, or use that is
not in accord with the approved plan of development, shall not be initiated without the prior
written approval of the authorized officer. A copy of the complete right -of -way grant, including all
stipulations and approved plan of development, shall be made available on the right -of -way area
during construction, operation, and termination to the authorized officer. Noncompliance with
the above will be grounds for immediate temporary suspension of activities if it constitutes a
threat to public health and safety or the environment.
g.
Any cultural and /or paleontological resource (historic or prehistoric site or object) discovered by
the Holder, or any person working on his behalf, on public or Federal land shall be immediately
reported to the Authorized Officer. The Holder shall suspend all operations in the immediate
area of such discovery until written authorization to proceed is issued by the Authorized Officer.
An evaluation of the discovery will be made by the Authorized Officer to determine appropriate
actions to prevent the loss of significant cultural or scientific values. The Holder will be
responsible for the cost of evaluation and any decision as to proper mitigation measures will be
made by the Authorized Officer after consulting with the Holder.
h. The Holder shall be responsible for total control of all invasive /noxious weed species on any and
all disturbed sites. The Holder is responsible for consultation with the Authorized Officer and /or
local authorities for acceptable weed control methods, and shall comply with the following:
Use of pesticides shall comply with all applicable Federal and State laws. Pesticides shall be
used only in accordance with their registered uses within limitations imposed by the Secretary of
the Interior. Prior to the use of the pesticides, the Holder shall obtain from the Authorized
Officer, written approval of a Pesticide Use Proposal Plan showing the type and quantity of
material to be used, pest(s) to be controlled, method of application, locations of storage and
disposal of containers, and any other information deemed necessary by the Authorized Officer.
Applicator(s) of chemicals used must have completed the pesticide certification training and
have a current up to date Certified Pesticide Applicator's License.
Pesticide Application Records for the areas and acres treated must be submitted to the BLM
Kemmerer Field Office each year. This includes the following:

Method of treatment (air /ground)
Name of applicator

Amount of surfactants or dyes used in spraying operation
The record information must be recorded no later than 14 days following the pesticide
application and must be maintained for two years.

h. Construction activity and surface disturbance will be prohibited during the period from February 1
through July 31 for the protection of raptor nesting habitat;
Construction activity and surface disturbance occurring during the period from April 10 to July 10
will require surveys of nesting /brooding habitat for the protection of Mountain Plover Nests.
The Holder may request an exception in writing to the above stipulation. Any exceptions to the
stipulation must be approved in writing by the Authorized Officer prior to conducting any surface
disturbing or prior to conducting activities disruptive to wildlife. The exception request must
explain the reason(s) for the exception, why the proposed activities will not impact the species or
their habitat, and the dates for which the exception is requested. Data supporting the exception
must accompany the written request.
Except rights -of -way expressly authorizing a road after construction of the facility is completed,
the holder shall not use the right -of -way as a road for purposes other than routine maintenance
as determined necessary by the authorized officer in consultation with the holder.
The holder shall furnish and apply water or other means satisfactory to the authorized officer for
dust control.
k. No construction or routine maintenance activities shall be performed during periods when the
soil is too wet to adequately support construction equipment. If such equipment creates ruts in
excess of three inches deep, the soil shall be deemed too wet to adequately support
construction equipment. Frozen soil or soil mixed with snow will not be used in construction.
The holder shall conduct all activities associated with the construction, operation, and
termination of the right -of -way within the authorized limits of the right -of -way.
m. Holder shall remove only the minimum amount of vegetation necessary for the construction of
structures and facilities. Topsoil shall be conserved during excavation and reused as cover on
disturbed areas to facilitate regrowth of vegetation.
n. Ninety days prior to termination of the right -of -way, the holder shall contact the authorized officer
to arrange a joint inspection of the right -of -way. This inspection will be held to agree to an
acceptable termination (and rehabilitation) plan. This plan shall include, but is not limited to,
removal of facilities, drainage structures, or surface material, recontouring, topsoiling, or
seeding. The authorized officer must approve the plan in writing prior to the holder's
commencement of any termination activities.

I. PROJECT DESCRIPTION

The buried 6 inch steel pipeline will head in a Northeasterly direction from the proposed Opal
#80 -30 well that is staked in the SW /4SE of Section 30, Township 22 North, Range 112
West to a portion of an existing pipeline that is in the SE /4 of Section 30, Township 22
North, Range 112 West, of Sweetwater County, Wyoming.
The total length of the ROW is approximately 1,945 feet, of which 1,945 feet are on Federal
lands. A 50 foot wide corridor is requested for construction, operational and maintenance
purposes, 2.233 acres.
The pipeline will consist of a 6 inch pipe, 0.188 inch wall thickness, Grade X -42 pipe with a
maximum operating pre4ssure of approximately 1200 psig. The average operating
temperature of the pipeline is between 50 °F and 60 °F.
Associated facilities include valving and metering.
Excluding the pipelines, all permanent, above ground facilities, valving and metering, not
subject to safety requirements, will be painted a flat non contrasting color harmonious with
the surrounding landscape. Present warehouse stock colors comprise of Carlsbad Canyon
(2.5Y 6/2 or Shale Crccn (5Y 1/2).
II. FACILITY PURPOSE AND NEED
The proposed pipeline will allow for the transport of natural gas from the well.
II. RECONNAISSANCE AND LOCATION
Field reconnaissance reveals that the route selected will comply with the request that the
pipeline follow the road. No other route alternatives were considered.
No adverse impacts of air quality are expected because of the minimal scope of the project
and the short duration of construction activities. The noise from the construction activities
will create a temporary disruption of ambient conditions; however, any disruption should be
of relatively short duration.
The construction of the proposed facility will not have any significant impact on the
surrounding environment. Any actual construction impact will be temporary

IV. ANCILLARY RIGHT -OF -WAY AND PERMITS
Access into the proposed pipeline project will be from existing highways and roads. All
construction and vehicular traffic will be confined to the right -of -way corridor or designated
county and /or BLM roads unless otherwise authorized and approved by the regulating
agency or landowner. No new access roads will be required for the construction of the
project. Approvals will be obtained from the BLM for the use of existing roads during
construction. Authorized roads will be rehabilitated to preconstruction conditions after
construction activities are complete, unless otherwise specified by regulating agency or
landowner.
Any associated building, zoning, and creek and utility crossing permits will be secured from
the appropriate regulatory agency prior to pipeline construction.
Specific service areas, work camps, or staging areas requiring additional land usage are not
being considered on the pipeline project.
V. ENGINEERING SURVEYS
All alignment maps, site specific details, and design drawings associated with the above
mentioned project are available for review at the offices of Mountain Gas Resources LLC,
located at 20 Shoshone Avenue, Green River, Wyoming 82935 upon request.
Mountain Gas Resources, LLC will protect all survey monuments, witness corners, reference
monuments, and bearing trees within the right -of -way against disturbance during
construction, operations, maintenance, and rehabilitation. If any monument, corner or
accessory is destroyed, obliterated, or damaged during construction, operation, or
maintenance, Mountain Gas Resources, LLC will have a registered surveyor restore the
disturbed monument, corner or accessory using surveying procedures found in the "Manual
of Surveying Instruction for the Survey of Public Lands of the United States. "1973 edition.
Mountain Gas Resources, LLC will record such survey in the appropriate county and send a
copy to the appropriate BLM office.
The right -of -way will parallel the proposed roadway, maintaining a total right -of -way width
of 50 feet within 15 feet of the edge of the road running surface. All vehicle traffic will be
confined to the road or the right -of -way.
VI. DESIGN
The design and engineering as well as the inspection of the proposed pipeline will be done
by Mountain Gas Resources, LLC personnel. Construction of the proposed pipeline will be
done by an independent contractor. The facilities will be operated and maintained by
existing contract personnel operating for Mountain Gas Resources, LLC. The pipeline and
associated facilities will be installed in compliance with all applicable state and federal
regulations.

All construction materials will be hauled to the job by truck. The materials will be strung
along the right -of -way as materials arrive. Pipe will be strung in such a manner as to cause
the least interference with the normal use of the land crossed by the right -of -way.
The pipeline construction corridor will be cleared of above ground vegetation and obstacles
with surface disturbance limited to that required to ensure a safe work area for equipment
and workers. Mountain Gas Resources, LLC will use a brush hog to cut the vegetation, such
as sage brush within as much of the ROW as is needed, no topsoil will be bladed to the side
of the ROW, except in cases where vegetation is too dense to be removed or in the interest
of providing a safe working area.
A wheel trencher will be used to dig a trench to a minimum depth of 36 inches, or an
average depth of 48 inches where possible, stacking the dirt beside the ditch. After the pipe
is placed in the ditch a motor grader or caterpillar will be used to push the dirt back into the
trench. The fill on the trench will then be tamped into place with the motor grader wheels,
leaving a berm of four inches to accommodate settling. Disturbance of the top soil within
the ROW will be kept to a minimum. In areas of excessively steep hillsides or to provide a
smooth approach to a cut or gully, as well as at stream bank crossings and at established
work stations, some blading may be required to provide a safe and suitable working area for
the equipment and workers. When this occurs the top six inches of soil will be stock piled on
the side of the ROW and spread back over the area from which it was taken, after the final
grading. Before seeding any disturbed areas (if applicable), the ROW will be restored to its
original form, slope, contour, and soil density to the extent practicable.
In areas of Desert Pavement terrain, no topsoil will be removed, and for minimal
disturbance of the desert pavement, the pipeline will be laid ±8' from the outside
shoulder of the borrow ditch. The spoil from the ditch will be put into the borrow
ditch and flattened to provide a safe work area. Only the areas that require blading
for safety reasons will be bladed. At those areas along the pipeline where
connections to future wells are planned, the centerline of the pipeline will be
installed 15' from the shoulder of the borrow ditch in order to provide adequate room
for above ground facilities and required protective guards. After the pipeline is
installed in the ditch, MGR will use the original spoil from the borrow ditch area to
back -fill the trench. The trench will be compacted in lifts using the motor grader
tire. Then final clean -up will take place. MGR will be using air as a test medium to
test the pipeline to a 1200 psi maop.
For drainages which are 8 to 10 feet deep or deeper, MGR will install a form of rip -rap (rock)
on the drainage bottom and will use geo -tech matting to stabilize the banks of the wash.
MGR will install erosion control measures per Wyoming DEQ and BLM standards. Whenever
a new proposed pipeline needs to be installed next to a new well or area access road, in an
area where a culvert is present, MGR will coordinate the pipeline installation with the
producer or whomever is responsible for the access or area road.
Once the pipe has been strung and lined up, a bending machine will be used to bend the
pipe in horizontal and vertical planes to fit the trench. After bending, the welding operation
will commence.

Following welding operations, the pre- coated or wrapped pipe will be lowered into the ditch.
The ditch may require padding (sand or soil) if rocky areas are encountered. For larger
diameter pipe, this will be accomplished using a ditch padding machine. For smaller
diameter pipe, a rock shield material will be used. No material /borrow sites are anticipated
for the construction of the pipeline.
All road crossings will be buried to a minimum of 60 inches below the borrow area.
Any pipeline above ground facility, i.e., risers, valves, pig receivers and launchers,
scrubbers, etc. in the pipeline right -of -way near any established right -of -way, will have
permanent barricade guards placed around, especially equipment around or near roads, to
prevent any damage from vehicle accidents. The guards will be structurally sound, with a
minimum 6 -inch diameter pipe, cement filled and anchored as directed by the BLM office.
All welding will be conducted in compliance with the American Petroleum Institute (API)
Standards 1104, "Welding of Pipelines and Related Facilities."
The following is a list of construction equipment proposed on the pipeline project:

VII. HAZARDOUS MATERIALS
If toxic substances are required, usage shall conform with provisions of the Toxic Substance
Control Act of 1976, as amended (40 CFR Part 702 -799). Any release of toxic substance
(leaks, spills, etc.) in excess of the reportable quantity as established by 40 CFR Part 117.3,
shall be reported as required by the Comprehensive Environmental Response,
Compensation, and Liability Act of 1980, Section 102 b. A copy of any requested report
required by any federal or state agency of a reportable release or spill of any hazardous
materials shall be furnished to the authorized officer within 5 working days of the occurrence
of the spill or release.
VIII. PLANS AND SPECIFICATIONS
All pipeline plans, drawings, and specifications are available for review upon request in the
offices of Mountain Gas Resources, LLC, in Green River, Wyoming. Also, if any site specific
plans or drawing are required, those will be submitted to the appropriate regulatory agency.

IX. CONSTRUCTION
Mountain Gas Resources, LLC will notify the authorized officer of any fires during pipeline
construction. Mountain Gas Resources, LLC will comply with all rules and regulations
administered by the authorized officer concerning the use, prevention, and suppression of
fires on federal lands.
Mountain Gas Resources, LLC, or its contractor, will take the initial fire suppression action in
the work area. Suppression actions will continue until the fire is out or until the crew is
relieved by an authorized representative of the agency on whose land the fire occurs. Heavy
equipment will not be used for fire suppression outside the right -of -way limits without prior
approval of the authorized officer, unless there is imminent danger to life or property.
Mountain Gas Resources, LLC or its contractor will be responsible for all cost associated with
the suppression and rehabilitation if the fire started as a result of Mountain Gas Resources,
LLC's operations, an employee of Mountain Gas Resources, LLC or its contractor.
Mountain Gas Resources, LLC will, at all times during construction, maintenance, and
operations, maintain satisfactory spark arrests on internal combustion engines.
Mountain Gas Resources, LLC will notify the authorized officer 5 days in advance of starting
any construction activities. All safety measures have been considered in the design,
construction, operation, and maintenance of the facility. Mountain Gas Resources, LLC will
have inspectors present during construction. Any accidents to persons or property on
federal lands will immediately be reported to the authorized officer.
Mountain Gas Resources, LLC will have an adequate number of pipeline inspectors on the
job to oversee all phases of pipeline construction to assure that the constructed pipeline
conforms to all applicable state and federal regulations. A manager /coordinator will be
assigned to the pipeline project to work with the contractor and officials from the local,
state, and federal agencies, on routine or emergency situations.
The construction period will last approximately two weeks, contingent upon weather
conditions. The construction workforce is expected to number approximately eight to ten
people at the peak of construction. The construction work force will commute daily.
If a preconstruction conference is required to review stipulations of the grant, Mountain Gas
Resources, LLC will have the Project Manager attend along with various pipeline and
construction representatives.
Mountain Gas Resources, LLC will not allow any construction or routine maintenance
activities during periods when soil is too wet to adequately support construction equipment.
If such equipment creates surface ruts in excess of 4 inches deep, Mountain Gas Resources,
LLC will deem that soil conditions are too wet to adequately support construction equipment.
Construction activities will not be allowed until soil conditions improve or prior approval has
been obtained from the BLM.

If applicable, the contractor will provide portable toilets to handle all sanitary waste during
pipeline construction. All other waste, trash, or refuse will be stored in containers and
disposed of at an approved county landfill.
A Class III Archaeological Report was previously completed and submitted in conjunction
with the well pad and access road.
If any cultural or paleontological resources (historic or prehistoric site or objects) are
discovered by Mountain Gas Resources, LLC personnel or associated pipeline contractors on
public or federal lands, immediate notification of the discovery will be made to the
authorized officer. Upon discovery of a site, Mountain Gas Resources, LLC will coordinate
with the authorized officer in determining appropriate actions to prevent the loss of
significant cultural or paleontological values.
Mountain Gas Resources, LLC will not construct in frozen soils. If construction is
required when the soil is frozen, all of the six (6) BLM frost guidelines will be
complied with, and those 6 steps are:
1. Snow will be removed and the vegetation will be scalped with a motor grader.
The vegetation will be windrowed to one side of the right -of -way
2. A wheel trencher will be used to remove approximately 6 -8 inches of
topsoil.
3. The ditch will be dug to the required depth using the wheel trencher and the
topsoil will be stockpiled to one side.
4. Install the pipeline and backfill the trench.
5. Place the stockpiled topsoil in the trench.
6. Place the scalped vegetation back on the right -of -way using the motor grader,
and reseed when appropriate.
7. Top soil salvage will be 6" minimum.
All pipeline trenches that may have to remain open for a period of ten (10) days, soft
plugs will be installed every 1 /4 mile for animal traffic. When stringing pipe the
contractor will set back one joint every 1 /4 mile at soft plug locations for animal
traffic.. All tin horns or below ground vaults will be covered for the protection of
animals during and after construction.
All portable drip catchers, if installed, will be covered.
Pipeline markers will be installed within the line of sight only, without voiding safety
issues.
X. STABILIZATION AND REHABILITATION
All disturbed areas will be reshaped and contoured as near as possible to its original
condition. This reclamation will be accomplished as soon as possible after the disturbance
occurs. Appropriate measures will be taken to prevent erosion.

Before seeding all disturbed areas, the right -of -way will be restored to its original form
slope, contour, and sill density to the extent practical. Stockpiled topsoil will be the top layer
and will be evenly spread over the disturbed area. After pipeline construction is completed,
pipeline markers will be installed for identifying the pipe's location. Mountain Gas
Resources, LLC will not use the right -of -way for road purposes other than routine pipeline
maintenance, pipeline inspections, and in emergency situations.
Water bars will be constructed in accordance with the requirements of the governing agency
or landowner.
The maximum slope distance between the waterbar structures will be as follows:
For grades of 1% or less, the slope distance will be 200 feet;
For grades of 1% to 5 the slope distance will be 100 feet;
For grades of 5% to 8 the slope distance will be 50 feet;
For grades of 9% and above, construction dikes will be constructed as directed by the
authorized officer.
All topsoil will be conserved for reclamation purposes and excess topsoil, if any, will be
stockpiled for soil replacement along the pipeline corridor.
Reseeding of the pipeline right -of -way will commence as soon as possible after completion of
the pipeline or when stipulated by the governing agency or landowner.
Any brush, slash, etc. will be spread along the right -of -way, and /or placed in drainages to
control erosion. Any large rocks that are required to be moved for the project will be
replaced back within the right -of -way.
Mountain Gas Resources, LLC will seed all disturbed areas with the seed mixture specified in
the APD for the well, as follows:

Seed will be planted using a drill equipped with a depth regulator to ensure proper depth of
planting where drilling is possible. The seed mixture will be evenly and infirmly planted over
the disturbed area. Where drilling is not possible, seed will be broadcasted and raked or
chained to cover the seed. If seed is broadcasted by hand, the seed mixture will be doubled
in pounds per acre.
XI. OPERATION AND MAINTENANCE
Mountain Gas Resources, LLC will conduct all activities associated with the construction,
operations, and termination of the right -of -way within the authorized limits of the right -of-
way. The pipeline will be routinely patrolled and inspected by foot or vehicle from the road
way to check for problems such as right -of -way conditions, unauthorized encroachment on
the right -of -way, and any other situation that could cause a safety hazard or require
preventive maintenance. If damage should occur to the pipe from external sources, repair

emergency procedures are used as routine operational procedures by Mountain Gas
Resources, LLC.
Mountain Gas Resources, LLC. will not conduct hydrostatic testing on the pipeline. It
is Mountain Gas Resources, LLC. policy not to conduct hydrostatic testing on pipelines

Mountain Gas Resources, LLC. will be responsible for weed control on the disturbed
areas within the established limits of the ROW. Mountain Gas Resources, LLC. will
coordinate with the authorized officer or local authorities, to obtain acceptable weed
control methods for the disturbed areas within the ROW limits.
XII. STABILIZATION AND ABANDONMENT
Opal #80 -30 Well Connect
At the end of the pipeline's useful life, Mountain Gas Resources, LLC will obtain any
necessary authorization to abandon the facilities from the appropriate regulatory agency. If
necessary, Mountain Gas Resources, LLC will contact the authorized officer to arrange a joint
inspection of the right -of -way. The inspection will be held to jointly agree on an acceptable
rehabilitation and termination plan.
At this time, all above ground pipeline facilities will also be removed and all unsalvageable
materials will be disposed of at authorized sites. Regrading and revegetation of disturbed
land areas, if applicable, will be completed as necessary. In addition, the abandoned right
of -way will revert to the agency's control.
