Shane Johnson, Sheriff, of lawful age, being first duly sworn upon his oath
according to law, deposes and says:
1. That he is now, and was at all times herein mentioned, the duly appointed,
qualified and acting Sheriff of Lincoln County, Wyoming.
2. That on the 30th day of March, 2010, at 10:00 o'clock A.M., at the front door
of the Courthouse of the County of Lincoln, State of Wyoming, in Kemmerer, Wyoming,
the same being also the place of holding the District Court in said County, and at public
venue, to the highest bidder for cash, he offered for sale the following- described land
and premises as a whole and sold the same for the sum of $129,000.00 to 1 Bank,
Afton, Wyoming the said bank having bid fairly and in good faith therefor, and being the
highest and best bidder, and that being the highest sum bid for all of said land and
premises, being particularly described as follows, to -wit:
Lot 149 of Star Valley Ranch Plat 18, Lincoln County, Wyoming, as described
on the Official Plat filed on May 3, 1979 as Instrument No. 523540 of the
Records of the Lincoln County Clerk.
SUBJECT to all easements, rights of way, reservations, mineral leases,
restrictions and restrictive covenants now of record or in sight and affecting
said property.
Together with all improvements thereon.
3, That said lands and premises were sold pursuant to that certain Notice of
Intent to Foreclose Mortgages by Advertisement and Sale being duly given according to
law, and pursuant to the provisions of that certain Notice of Mortgage Foreclosure Sale
duly published by Iaw, and under and by virtue of the power of sale and authority
contained in that certain Mortgage, dated June 30, 2008, made, executed and delivered by
Craig Smith, as Mortgagor, to 1st Bank, Alpine, Wyoming, as Mortgagee, which Mortgage
was filed for record in the Office of the County Clerk and Ex- Officio Register of Deeds
within and for Lincoln County, Wyoming, on July 2, 2008, in Book 699 at Page 58, Rec.
#940259; modified on June 30, 2009, and re- recorded on July 6, 2009 in Book 726, at
Page 825 at Rec. #948144, and that the debt secured by said mortgage deed at the time of
said sale, including principal, interest, advances, fees, costs and expenses of foreclosure
was the actual sum of $190,726.47.
4. That a Certificate of Sale on Foreclosure was thereafter issued by the
undersigned to 1st Bank, Afton, Wyoming as the purchaser, dated March 30, 2010, which
Certificate was recorded on March 30, 2010, in Book 744, at Pages 638 -648, Filing No.
9527177, in the office of the County Clerk and Ex- Officio Register of Deeds of Lincoln
County, Wyoming.
5. That the time of redemption of said premises by Craig Smith, expired on the
30th day of June, 2010, and that Craig Smith, his heirs, executors, administrators, or
assigns has not redeemed said property; that the time in which any judgment creditor of
said Craig Smith, or grantee or mortgagee, or any person holding a lien on such premises
or property, may redeem such premises and property, expired on the 30th day of July,
2010, and no such person has redeemed such property, and the purchaser aforesaid is
now entitled to a deed for said property and premises.
NOW, THEREFORE, KNOW ALL MEN BY THIS DEED, that I, Shane Johnson, Sheriff of
said County of Lincoln, State of Wyoming, in consideration of the premises, have granted,
bargained and sold, and do hereby convey to 1st Bank, Afton, Wyoming, its successors and
assigns, the following described property:
To have and to hold the same described property and premises with all
appurtenances thereunto belonging, to the said 1st Bank, Afton, Wyoming, its successors
and assigns.
