James K. Sanderson, as attorney for Plaintiff Jared Erickson d /b /a Erickson.
Excavators, Inc., after first being duly sworn, upon his oath declares and states as
follow:
1. That he, a resident of Lincoln County, State of Wyoming, over 21
years of age, is the attorney for the Plaintiff herein, and is duly authorized to
execute this Lis Pendens.
2. That Jared Erickson, d /b /a Erickson Excavators, Inc., is the Plaintiff in
Civil No. CV- 2010 156 -DC, in the Third Judicial District, Lincoln County, State
of Wyoming.
3. That Plaintiff has caused to be filed a Complaint which raises, among
other issues, the Plaintiff's right to title and possession of a certain parcels of land
in payment for work done in reliance on a contract with the Defendants. The
parcels are located in Thayne, Lincoln County, Wyoming, with a legal description
as follows:
Parcel 1: Commencing 7 1/4 rods North of the Southwest Corner of the
Southwest Quarter of the Northwest Quarter of said Section 18 and running
thence North, 21 rods;
thence East, 28 1/ rods
thence South, 28 1/4 rods;
thence West, 18 1/4 rods;
thence North, 7 1/4 rods;
thence West, 10 rods to the Place of Beginning.
ALSO, commencing at the Southwest corner of the Southwest Quarter of the
Northwest Quarter of said Section 18; and, running thence North 7 1/4 rods;
thence East, 10 rods;
thence South, 7 1/4 rods;
thence West, 10 rods to the Place of Beginning.
LESS AND EXCEPT the land described in Quitclaim Deed recorded August
29, 2005 in Book 595 on Page 830 of the records of the Lincoln County
Clerk.
Parcel 2:
Part of Section 13, Township 34 North, Range 119 West of the 6th P.M.,
Lincoln County, Wyoming being more particularly described as follows:
Commencing 33 rods South of the Northeast Corner of the Southeast
Quarter of the Northeast Quarter of said Section 13; and, running thence
West, 130 rods;
thence North, 32 rods;
thence West, 18 rods;
thence Southwesterly, 73 rods;
thence East, 155 3/ rods;
thence North, 41 rods to the Place of Beginning.
LESS AND EXCEPT the described in Warranty Deed recorded July 22,
2001 in Book 467PR on page 180 of the records of the Lincoln County
Clerk.
Parcel 3:
North One Half of the Northeast Quarter of the Southwest Quarter of
Section 13, Township 34 North Range 119 West of the 6th P.M., Lincoln
County, Wyoming.
LESS AND EXCEPT the land described in Warranty Deed recorded June
16, 1993 in Book 330PR on page 495 of the records of the Lincoln County
Clerk.
4. This notice is made pursuant to Wyoming Stat. Ann. 1-6--107 and
gives notice of the pendency of the aforementioned action to any individuals or
entities claiming a right, title or interest in and to the aforementioned property or
any parties intending to acquired a right title, or interest to the property form the
above entitled individuals or entities.
5. The object of the aforementioned action is to recover sums owed to
the Plaintiff as payment for excavation work done in reliance on the contract at
issue.
6. This Lis Pendens shall be construed as notice of interest in and to the
subject property referred to above.
