HomeMy WebLinkAbout954866PARTIAL VACATION OF STAR VALLEY RANCH RV PARK PLAT 4 STAGE I Comes now Harold Val Stewart, President of Leisure Valley, Inc., a Nevada corporation of P.O. Box 299, Thayne, Wyoming 83127, County of Lincoln, State of Wyoming, who does hereby make the following statement of facts: 1. That Leisure Valley, Inc., a Nevada corporation, is the sole owner of the following lots within Star Valley Ranch RV Park Plat 4 Stage 1 Phase I, of record in the Office of the Clerk of Lincoln County, with Accession No. 936769. Lots 658 through 730, inclusive, of Star Valley Ranch RV Park Plat 4 Stage 1 Phase I of record in the Office of the Clerk of Lincoln County, with Accession No. 936769. 2. That in accordance with Wyoming Statutes, 2009, as amended, Section 34 -12 -108, it does hereby vacate said lots and that portion of Buckboard Drive, Muleshoe Road and Stagecoach Lane lying and being situate southerly of Stewart Drive and northerly of Long Branch Lane, and that portion of Long Branch Lane lying and being situate westerly of Whiffle Tree Drive and easterly of Hub Road, as depicted on the attached "Exhibit A 3. That the Board of County Commissioners of Lincoln County approved said vacation at its regular meeting on Ai,�t;�i� 11 I at\ i 0 in accordance with Resolution No'* dated E C7 4. That, in accordance with Wyoming Statutes, 2009, as amended, Section 34 -12 -110, the County Clerk is respectfully requested to write the word "vacated" across the face of above referenced lots and roads and make reference to the same in the Book and page where it is recorded in accordance with Section 34 -12 -110. 5. That, Leisure Valley, Inc. affirms all rights of the utility companies to the streets, alleys and the easements for utilities such as water, sewer, electrical power lines, gas lines, telephone line, etc. of said subdivision as granted on said plat and confirms that these elements of said subdivision are unaffected by said vacation. 6. That such vacating does not abridge or destroy any of the rights and privileges of other proprietors in said plat; and provided, further, that nothing contained in this action shall authorize the closing or obstruction of any public highways laid out according to law. 7. That Leisure Valley, Inc. affirms that said vacated lots are subject to the Declaration of Covenants, Conditions and Restrictions of record in said Office in Book 698 of Photostatic Records on page 646, and the First Amendment and Full Restatement of Declaration of Covenants, Conditions and Restrictions of record in said Office in Book 737 of Photostatic Records on page 502 and Second Amendment and Full Restatement of Declaration of Covenants, Conditions and Restrictions of record in said Office in Book 743 of Photostatic Records on page 183 Harold Val Stewart, President State of Wyoming ss...
