HomeMy WebLinkAbout955664DEED IN LIEU OF FORECLOSURE KNOW ALL MEN BY THESE PRESENTS, That R &R BUILDERS, INC., a Wyoming Corporation, and ROBERT WAGNER and RAY BERGSTROM, as officers of said corporation and as individuals, of the County of Lincoln, State of Wyoming, in consideration of the sum of Ten and No /100 Dollars ($10.00) and other good and valuable consideration to it in hand paid by 1ST BANK, a United States banking corporation, of Alpine, Wyoming, its successors and assigns, 79 Highway 89, P.O. Box 3110, Alpine, Lincoln County, State of Wyoming, the receipt whereof is hereby confessed and acknowledged, have remised, released, and forever quitclaimed and by these presents does for their heirs, executors and administrators, remise, release and forever quitclaim unto 1ST BANK, of Alpine, Wyoming, its successors and assigns, forever, all such right, title, interest, property, possession, claim and demand, as he may have or ought to have, in or to all the following described premises to wit: Lot 34 of Salt River Cove Division No. 2, Lincoln County, Wyoming as described on the official plat thereof, together with all improvements thereon, and easements, appurtenances and incidents belonging or appertaining thereto, or used in connection therewith; subject, however, to all mining, mineral and other exceptions, reservations, covenants, conditions and rights of way of record. This Deed is an absolute grant of title in effect as well as in form, and is not intended by the Grantor to be a mortgage. The conveyance herein is subject to acceptance by the 1ST BANK, of Alpine, Wyoming, and the Grantor acknowledges that 1ST BANK's interest in the above described property shall not merge with any existing mortgages in favor of the Grantee and that any such mortgages encumbering the above described property shall remain in full force and effect until a mortgage release is properly recorded by the Grantee. The acceptance of this Deed and the consideration therefore shall be evidenced by and be the recorded Release of said Mortgage(s). The Grantor hereby releases and waives all rights under and by virtue of the homestead exemption laws of the State of Wyoming. TO HAVE AND TO HOLD the said premises unto the 1ST BANK, of Alpine, Wyoming, its successors and assigns forever. R &R BUILDERS, INC., and ROBERT WAGNER and RAY BERGSTROM, as officers of said corporation and as individuals, nor any other person on their behalf, shall or will hereafter claim or demand any right or title in the premises or any part thereof, but we, them and every one of them shall by these presents be excluded and forever barred.
