JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY JUDGMENT AND WRIT OF ATTACHMENT [CV- 2009 258 -DC and CV- 2009 263 -DC] This matter having come before the Court pursuant to that STIPULATION AND MOTION FOR ENTRY OF JUDGMENT AND WRIT OF ATTACHMENT, entered into between Plaintiff Suzanne Gano "Gano] and Defendants James Ivan Ridge, the James Ivan Ridge Trust U /A /D 12.21.99, Gem View Enterprises, LLC, Aspen Ridge Ranch, LLC, Spirit Ridge Mineral Springs, LLC and Whisper Ridge Holdings, LLC [collectively "D efendants whereby all parties to this action have consented to and requested the immediate entry of this JUDGMENT AND WRIT OF ATTACHMENT; and the Court finding that Plaintiff is entitled to judgment against the Defendants as to the claims set forth in her Complaints as filed in the consolidated actions; 006705 NOW THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED AS FOLLOWS: 1. The facts as set forth in Plaintiffs COMPLAINT are true and accurate and are incorporated herein; 2. Plaintiff is hereby awarded judgment against the Defendants, and each of them, jointly and severally, for the following: (a) $467,126.15 as of June 15, 2010, plus (b) $41,914.00 in Child Support arrearage as of June 15, 2010, plus (c) $1,000.00 in Costs, plus (d) $25,000.00 for Attorneys' fees, For a TOTAL of Five Hundred and Thirty -Five Thousand and Forty Dollars and Fifteen Cents $535,040.15, plus stipulated post judgment interest accruing on only $510,040.15 of the Judgment Amount, at the rate of 9% from June 15, 2010; plus any subsequent costs and attorneys' or professionals' fees incurred by this Court's appointed Receiver, whose appointment shall assist Gano in the satisfaction of those amounts hereby adjudged to be rightfully owed to Plaintiff by the Defendants, and each of them. IT IS HEREBY FURTHER ORDERED, ADJUDGED AND DECREED THAT: 3. Defendants maintain various record ownership interests in the following described real properties located in Lincoln County, Wyoming, which property interests are and shall be subordinate to and subject to this JUDGMENT AND WRIT OF ATTACHMENT, and which property interests and title ownership are hereby ATTACHED pursuant to Wyo. Stat. 34- 14- 208(ii) in accordance with the procedure prescribed by law: Brough Property 1: Lot 1 of Gem View Estates, Lincoln County, Wyoming as described on the official plat No. 305 -B filed December 21, 2005 as Instrument No. 914639 of the records of the Lincoln County Clerk. Brough Property 2: Tract 1: The SW' /4NW 1/4 of Section 23, T31N, R119W of the 6`'' P.M., Wyoming. Defendants James Ivan Ridge, the James Ivan Ridge Trust, Gem View Enterprises, LLC, Aspen Ridge Ranch, LLC, Spirit Ridge Mineral Springs, LLC and Whisper Ridge Holdings, LLC are hereby enjoined and prohibited from further transferring, deeding or encumbering the above described real properties [or any part or portion of them] unless said properties are deeded, transferred or encumbered as a result of this Court's Receiver's actions, or with written permission and release of Plaintiff Gano, or in conformance with the terms and conditions of any written and signed contract or agreement Gano and the Defendants have entered into. 5. Pursuant to Wyo. Stat. 34- 14- 208(b) a Receiver is hereby appointed to take charge of the herein described Lincoln County real properties and to take any and all suitable action by attachment and execution sale for the liquidation of any part or all of the properties, in any order that the Receiver deems suitable for attachment and sale, at a public auction, and in the manner prescribed by law, with the proceeds of such sale [after the Receiver retains his costs, fees, professional service fees, disbursements and costs of sale] to be applied to the payment of this Judgment and the interest thereon accrued, and for the Receiver to issue and deliver to purchaser(s) at the sale a CERTIFICATE OF SALE for any one or all of the Defendants respective ownership interests or title in and to the real properties described herein. 00 ?Pat) 6. The effective date of the Court Appointed Receiver's appointment shall be on the date of Plaintiff Gano's submission to this Court of an Application for Appointment of Receiver, and this Court's entry of that ORDER APPOINTING RECEIVER [approved as to form by all parties to the action.] The appointed Receiver shall be either the Lincoln County JUDGMENT AND WRIT OF ATTACHMENT PAGE 6 Sheriff or an attorney licensed in the State of Wyoming who is not interested in the action, to be determined and identified by Plaintiff in her Application for Appointment of Receiver. Pursuant to each of the Defendants' waiver and consent, and this Order, the Receiver's appointment shall not require the posting of any bond or surety as set forth in Wyo. Stat. 1 -33 -103, or the publication of notice as to the Receiver's subsequent appointment as set forth in Wyo. Stat. 1 -33 -108 or 109. Any and all costs, fees, and professional fees of the Receiver which are hereafter incurred to effect the satisfaction of this Judgment shall be born by the Defendants, and added to the Judgment Amount and shall be taxed as costs and collected from the execution sale proceeds as set forth in Wyo. Stat. 1 -17 -416. The Receiver shall have full authority, pursuant to Wyo. Stat. 1 -17 -322, as Master Commissioner to execute conveyances of the above described real properties when sold by him under the terms of this JUDGMENT AND WRIT OF ATTACHMENT and that ORDER APPOINTING RECEIVER, and shall have those other powers to act as set forth and described in Wyo. Stat. 1 -33 -104. 7. In effecting the terms of this JUDGMENT AND WRIT OF ATTACHMENT, it is the express contemplation of this Court that the Receiver shall act outside the territorial limitations of the State of Wyoming, and to that end, the Receiver is authorized and shall take all necessary action to obtain ancillary jurisdiction over this Judgment or his Receivership, and shall register as a foreign judgment this Judgment or his order of appointment pursuant to the Full Faith and Credit Clause of the United State's Constitution, in the State of Idaho, and so as to effect the attachment, foreclosure or execution sale of Defendants' interests in the following Idaho properties: Steed Property Idaho Portion: SE1 /4 SW1 /4, Lot 1, Section 26, Township 7 South, Range 46 East of the Boise Meridian, Caribou County, State of Idaho; and Lot 1, Section 35, Range 46 East of the Boise Meridian, Caribou County, State of Idaho; JUDGMENT AND WRIT OF ATTACHMENT PAGE 7 Celcer Trust Property [Steed Access Parcel Idaho]: NE1 /4 NW1 /4 Section 35, Range 46 East of the Boise Meridian, Caribou County, State of Idaho. Pursuant to each of the Defendants' consent, and this Order, the Receiver shall have sole authority to appoint and hire an Idaho attorney [including Plaintiff Gano's attorney of record] to act as his representative and assist him in effecting the terms of THIS JUDGMENT AND WRIT OF ATTACHMENT and this Court's ORDER APPOINTING RECEIVER in Idaho. The Receiver's actions and execution on the Defendants' real properties in both Wyoming and Idaho shall otherwise be in conformity with applicable Wyoming and Idaho law. IT IS HEREBY FURTHER ORDERED, ADJUDGED AND DECREED THAT: 9. All of the Defendants' various and respective lands and tenements are bound for the satisfaction of this JUDGMENT AND WRIT OF ATTACHMENT, which is effective as a judgment lien attaching to said properties as of the date of its entry, and which shall be first and prior to the interests of James Ivan Ridge, the James Ivan Ridge Trust, Gem View Enterprises, LLC, Aspen Ridge Ranch, LLC, Spirit Ridge Mineral Springs, LLC and Whisper Ridge Holdings, LLC, and each of them, and anyone claiming by or through them, except for any of those prior -in -time and valid equities, to include those previously existing encumbrances and mortgages of record. JUDGMENT AND WRIT OF ATTACHMENT PAGE 9 00 0713 10. Plaintiff Gano is hereby granted the right: a. To cause the Defendants' real properties to be levied upon by the appointed Receiver or Sheriff of any county in which the real properties are located; and if the properties are located in a State outside of the Wyoming, after obtaining appropriate ancillary jurisdiction to act in that foreign state; b. To have the Defendants' real properties sold at an execution sale in partial or full satisfaction of this judgment, such sale to constitute a foreclosure of Gano's judgment liens by judicial process; c. To apply the proceeds from the sale of the Defendants' real properties to the payment of this JUDGMENT AND WRIT OF ATTACHMENT after payment of all collection and sale expenses, including the Receivers costs and professional fees. 11. Gano shall be entitled to recover all foreseen and unforeseen costs associated with obtaining full satisfaction of amounts hereby adjudged to be rightfully owed Plaintiff by Defendants, and each of them. 12. Jurisdiction of this cause is hereby expressly reserved and retained for the purpose of making such further orders as may be necessary in order to carry this JUDGMENT AND WRIT OF ATTACHMENT into effect and to correct any mathematical error, to grant any accrued credits, or for the purpose of making such further orders as may be necessary or desirable. 13. This JUDGMENT AND WRIT OF ATTACHMENT shall be considered to be a final judgment and is intended to constitute the final judgment in this matter. OS I SO ORDERED this ,5 day o 2010.
