The short portion of roughed -in work you did manage to hurriedly get done in 2009 on the south access road has never been completed; and most recently you requested permission to alter the north access road's alignment, which I stated I would have to see in writing and approve, whereupon instead of providing me with the documentation and allowing me any say in the alteration, you immediately rushed to install a monstrous road that does not meet any of the requirements, especially that of giving us access to our land to the south: we are prevented from accessing our land from this monstrosity, leaving us to continue to enter via the original unimproved farm road where you are contracted to have placed the improved road. The horrendous scar upon the land that is this "Great Wall of China impersonator you have installed instead, is a grievous eyesore, as well as a breach of our contract. After deceptively installing this completely separate road that does not meet your obligations in any way, you then informed your Realtors, Skip McCrary and Tom Davis, that you had fulfilled your obligation and that the old farm road, our only access into our land, "is no longer an easement whereby Skip illegally removed and disposed of our "For Sale" sign directing buyers to our land. When you stopped by my home in early September 2010 to inquire of my approval for an alteration, I made you aware that I know you have your land up for sale; you stated it was time to "get out In addition to being in default, by doing these things you violate the integrity and good faith intentions of our contract; it is obvious surreptitiously installing this illegitimate road is an attempt to permanently avoid fulfillment of your obligations by acquiring a buyer who will not be responsible for those same obligations. Therefor according to terms of our contract, specifically Clauses XIII A and B, I am now exercising my right to terminate your purchase contract for default.
