HomeMy WebLinkAbout956807RECEIVED 11/18/2010 at 10:21 AM RECEIVING 956807 BOOK: 757 PAGE: 458 JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY SIXTH AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR ALPINE VILLAGE SUBDIVISION OCQ 458 THIS SIXTH AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR ALPINE VILLAGE SUBDIVISION is made on the date hereafter set forth, by the AVR HOMEOWNERS ASSOCIATION, INC., a Wyoming Nonprofit Corporation. WHEREAS, the Declaration of Covenants, Conditions and Restrictions for Alpine Village Subdivision was filed in the land records of Lincoln County, Wyoming on November 13, 1973, in Book 108 PR at Pages 115 to 137 as Instrument No. 451667 (hereafter, "the Declaration by the Declarant, Alpine Village Realty, Inc., a now defunct Wyoming Corporation; and WHEREAS, the Declaration has been amended by the Declarant five times: on November 8, 1976, as recorded in Book 131 PR at Page 503 as Instrument No. 485605; on July 10, 1978, as recorded in Book147 PR at Pages 379 and 380 as Instrument No. 510789; on September 2, 1980, as recorded in Book 168 PR at Pages 21 and 22 as Instrument No. 544968; on January 15, 1981, as recorded in Book 172 PR at Pages 1 and 2 as Instrument No. 551420 (although the document as it appears in County records show the Book as "171 PR and on February 25, 1981, as recorded in Book 173 PR at Page 303 and 304 as Instrument No. 553483; and WHEREAS, the Declaration authorized the formation of a nonprofit corporation to assume all of the Declarant's "rights, duties, and obligations and WHEREAS, the owners of lots within Alpine Village Subdivision have formed the AVR Homeowners Association, Inc. as that nonprofit corporation; and AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR ALPINE VILLAGE SUBDIVISION PAGE 1 OF 3 0 04, ,Q459 WHEREAS, the AVR Homeowners Association, Inc. desires to amend the Declaration to allow for Master Plans that are approved by the Board of Commissioners of Lincoln County, Wyoming. NOW, THEREFORE, the Declaration is hereby amended as follows: 1. Declaration Article VI. Protective Covenants, Single Family Acreage, Paragraph 1, as previously amended, is hereby amended by adding at the end thereof the following: Notwithstanding any other provisions of the Declaration, as amended, any two -acre single family lots may be divided into one -acre parcels if such lot divisions occur as a part of a Master Plan approved by the Board of Commissioners of Lincoln County, Wyoming. 2. Declaration Article VI. Protective Covenants, Multiple Family, Paragraph 14, as previously amended, is hereby amended by adding at the end thereof the following: Notwithstanding any other provisions of the Declaration, as amended, any two -acre multifamily lots may be divided into one -acre parcels if such lot divisions occur as a part of a Master Plan approved by the Board of Commissioners of Lincoln County, Wyoming. 3. Declaration Article VI. Protective Covenants, Commercial Commercial Swing, is amended by adding at the end thereof a new Paragraph 15, as follows: Notwithstanding any other provisions of the Declaration, as amended, any commercial and commercial -swing lots may be divided into one -acre parcels if such lot divisions occur as a part of a Master Plan approved by the Board of Commissioners of Lincoln County, Wyoming. 4. This amendment has been adopted by the members of the AVR Homeowners Association, Inc. pursuant to its Articles of Incorporation and bylaws, and in accordance with the requirements of the Declaration regarding amendments, and shall become effective upon recordation in the land records of Lincoln County, Wyoming.
